WHEREUPON Sir Thomas Hope of Craighal Advocat to his Majeſty in his Majeſties name asked Inſtruments of me Notar Publick under ſubſcribing. This was done within the ſaid Palace of Whitehal, within his Majeſties withdrawing Chamber, the ſame Day, Place, and Year foreſaid, betwixt Eleven and Twelve houres before Noone, Before thir Witneſſes, George Duke of Buckinghame Sir James Fullartoun, Gentleman of His Majeſties Bed-Chamber, Sir William Alexander of Menſtrie Knight, Principal Secretary, Sir Archibald Atchiſon of Glencairn Knight, alſo Secretary to His Majeſty Sir George Elphingſtoun of Blythſood Knight, Juſtice-Clerk, Witneſſes required, and Deſired to the Premiſſes. Submiſſion made be the Biſhops and Clergie of SCOTLAND, To his Majeſty, Anent the Rights of Teinds.

AT The Day of One Thouſand, ſix Hundred Twenty eight years Wee the Arch-Biſhops, and Biſhops, and remanent Clergie within the Kingdom of Scotland under Subſcribing, Conſidering that His Sacred Majeſty, Our Dread Soveraign, out of His Royal Care, Fatherly and tender affection to the Publick good of all his Majeſties Subjects of His ſaid Kingdom for freeing them from the extremitie of damage, which may enſue to them, by leading of their Teinds Intends to take ſuch courſe as hereafter every Heretour may poſſeſs, and enjoy the Teinds of his own Lands for payment of a reaſonable Rate,and Dewty for the ſame; And Wee acknowledging our ſelves to be bound in Dewty for the advancement of that his Majeſties Royal deſign, tending to the Publick good of the Commonwealth. And being moſt willing that ſuch Heretours as are ſubject to the payment of any Teinds to Us or any of Us, may have their own, being deſirous therof, for payment to Us, and our Succeſſours of ſuch a reaſonable rate, and conſtant yearly Rent, as his Majeſty ſhall determine to be the Quota, and Rates of the Teinds, within the reſt of the Kingdom, ſo as the Rent and Dewty, in Silver, and Bols payed at the preſent, as well to Us, as to the Miniſters ſerving at our particular Churches, be not in any fort hurt or diminiſhed. And alſo conſidering the great benefite, which the ſaid courſe intended be His Majeſy, may Import to Us and our Succeſſours who are thereby to have a certain, and yearly Rent, which may not be altered by any Titulars in prejudice of their Succeſſours. THEREFORE to be bound and oblidged, Likeas Wee Bind and Oblidge Us, and Our Succeſſours, to grant to every Heretour of the ſeveral Lands, the Teinds whereof doe appertain to us, or any of us (being deſirous of the ſame) ſuch ſufficient ſecurity thereof, as may ſtand with the Laws of the Kingdom, and for ſuch a reaſonable Rate and Rent, or rentall Bols as his Majeſty ſhall determine to be the Quota, and Rate of the Teinds: Submiting our ſelves hereby, to his Majeſties Royal Decreet, and Sentence to be pronounced, at, or before the laſt Day of December, in the year of God 1619. And anent what lawful ſecurity in manner foreſaid, ſhall be made, and given by Us, or any of Us, to the ſaids Heretours of their own Teinds, belonging to Our Biſhopricks, or Benefices, for payments be made, be the ſaids Heretours, to Us, and Our Succeſſours of the ſaid Quota, and Rate or conſtant Rent, and Rental, to be ſet down be his Majeſty, for the ſaids Teinds, out of the ſaids Lands ſubject in payment thereof yearly, in ſuch manner, and at ſuch terms, as his Majeſty ſhall be pleaſed to appoint: And anent the making, ſetting down, and eſtabliſhing of the ſaid Quota, and Rate of the ſaids Teinds, Rental, or Rental-Bols, payable yearly, for the ſame to Us, and Our Succeſſours; And anent what Security the ſaids Heretours ſhall make, for the ſure, true, timeous, and thankful payment to Us, and Our Succeſſours, of the ſaid yearly Rent, and Rental Bols, at ſuch Times, and Terms of payment, as his Majeſty ſhall think ſit to be contained in the ſecurity of the ſaid Teinds: And anent the Annuity hereafter payable, be the ſaids Heretours, for encreaſeof his Majeſties Rent, Providing that Wee, and every one of Us, enjoy the Fruit, and Rent, of Our ſeveral Benefices, as they are Poſſeſt by Us, at this preſent time, and that the ſame be not hurt, nor diminiſhed, neither in quantity, nor quality, whether the ſame be payed to Us, in Rental-Bols, or by gathering of the Teind-ſheaves; But that Wee, and our Miniſters, provided to the particular Churches under us, and our, and their Succeſſours, may freely enjoy the ſame, without any alteration, and that ſuch Rent as ſhall hereafter belong, and accreſce to us, and any of us, and our Succeſſours, by his Majeſties ſaid Decreet, anent the ſaid Quota to be payed be the ſaids Heretours, for the remanent of the Teinds, which are not in our preſent poſſeſſion, be ſecured and made ſure to Us, and Our Succeſſours, leaving the ſaids Heretours of the Lands, out of which the Teinds are due unto Us, To ſubmit themſelves to his Sacred Majeſty his Decreet and Determination, anent the Annuitie, and other Premiſſes which concern them, to be pronounced before the ſaid laſt Day of December 1629. AND for the more ſecurity, Wee, and every one of Us, are content, and conſents, that thir preſents be Inſert and Regiſtrat, Together with his Majeſties Determination to follow thereupon, in the Books of Council, and Seſſion of Scotland, to have the ſtrength of a Decreet of the Lords thereof Interponed thereto and that all Letters, and Execution needful may paſs hereupon, in form as effeirs, and the Horning to paſs on a ſimple charge of Ten dayeſ
