t'8 6 The Third 'Parliament of and anent the Weaving and Bleatching of Linnen cloath, declaring, that if any Strangers fhail come, or be brought into this Kingdom by Natives to fet up, work, and teach his Art of making of Cloaths , .Stuffs , Stockings, Soap , or any kinde of Manufactory , That he mail enjoy the benefit of Law , and all other privi- ledges that a Native doth enjoy : with power to fet up Manufactories , either in Burgh orLand-ward , as they fhall think fit , and there to dwell , and exercife their Trade , without any flop or trouble ; and that they fliall have liberty and freedom of Trade, and to buy and purchafe Lands, and Heretages, and all other Goods moveable and immoveable , and all other priviledges , liberties , and capacities that do belong to any. Native Subject , born within this Kingdom. And For the Farther encouragement of Manufactories, all Oyl, dying Stuffs, forraign Wool , Lint, and Flax, Pot-alhes, or any other Materials whatfoever ufeful for Manufactories, that fhall be imported , are hereby declared to be free of Cuftom and Excife, and all other publick Dues in all time coming; and that all Cloaths, Stuffs /Stockings, or any other Commo- dities to be made , and exported by them , fliall be free of all Cultom and Excife , forthefpace of ninteen years after the date hereof. And it is farther declared, that any flock imployed , or to be imployed, for erecting and entertaining any Manufactories , the fame fliall be free of all private and publick Taxes what- foever , and all quartering and levying of Souldiers ; and all the Servants of the faids Manufactories fliall be free of watching, warding, Militia, or Levies during their aCtoal fervice rherein, forthefpace of feven years after the date hereof. WITH POWER to the Mailers , EreCtors, or entertainers of Manufac- tories , to meet for making of Ordinances for the Right ordering of their Servants , fuffieiency of their Stuffs, Cloaths, and others, and appointing Vifitors of their Works. AND HIS MAJESTY, with confent forefaid , RATIFIES and APPROVES the 43. ACl of the 1 . Seffion of His Majefties 1. Parliament, and the 46. Act of the fame Seffion of Parliament, difchairgeing the exporting of Linnen yarne ,, Worfleed , Woolen yarne, raw or unwaked Cloaths ( except PJaiding , Fingram, and Galloway white ) under the pain of Confifcation thereof ; And the Aft of Parliament ordaining , that Linnen of the price of Ten {hillings Sc ots the eln, or above, be not under the breadth of an eln and two inches , and that the fame be taken up by the Selvedge and not by the Ridge, and fo prefented to the Mercat, and that the fame be bleatched without Lime, under the penalty of Confifcation of the Linnen otherwayes taken up, and bleatched,andimprifonment, and Fyning of the perfons tranfgreflbrs, not exceeding the value of the Lin- nen. L I K E A S it is hereby ORDAINED, that hereafter, all Linnen brought to Mercat for publick Sale, be made up of Peeces and half Peeces, and that the Peece contain Twenty four elns , and the half Peece twelve elns, and that it contain not one eln more or le ; fs, under the pain of confifcation thereof. And that all Fingram , Plaiding , Linnen , and Woolen Droggats , to be made in time coming , fliall be of the breadth of three quarters and an nail, all Searges an eln and two inches, and the length of the Peece to be fifty , or fifty two elns to the whole Peace , and the half thereof to the half Peece , under the penalty forefaid , and that all the faids Peeces, whether Linnen or Woolen , be taken up in Folds , eln or three quar- ters long, and that none of them be rolled, that thereby the fufficiency of the whole Peece, may be known, and that the fame be not ftretched by the rolling, whereby the meafure will not hold out; and that under the penalty forefaid , for all fuch Cloath otherwife taken up and prefented to the Mercat. AND His Ma- jefly, with ADVICE and CONSENT forefaid, DOETH Authorize the Lords of His Privy Council, to declare thefe Manufactories already fet up, or that hereafter fliall be fet up, to be fuch, to the effect they may enjoy the Priviledges , Liberties , and Immunities granted by the faids Afts of Par- liament. AND for the more effectual execution of this Act , His Majefly with advice forefaid , O R- D A I N S the Collectors of the Afiefsment and Excife , and their Sub-Collectors , Farmcurers and Col- lectors of Cufloms, and Waiters in Burgh or Land, at every Term to give upon Oath, to the Judges ordinary upon the place by Sea or Land, and Juflices of Peace , Lifts of all thofe whom they have feen and obferved to tranfgrefs this Act. And it is hereby declared , that the one halt of the Penalties aforefaid , fliall belong to themfelves, and the other half fliall be collected by them for His Majefties ufe, tryal being firft taken, and the perfons found guilty by the faids Judges ordinary, or the Juflices of Peace , and fuch contraveeners as they fliall not give information of, that the one half of the Fynes fhall belong to any other perfon who fliall difcover them •. And in cafe the faids Collectors of Afiefsment and Excife, Farmourers, and Collectors of Cufloms, or Waiters fliall by connivance , or otherwayes Failzie to give up the faids Lifts as aforefaid, they fliall loofe their Places, and be incapable of that Office for ever. IT IS aiwayes hereby i provided , That no perfons contraveening this Act , lhall be lyable to the faids Penalties , unlefs they be found guilty within the fpace of three Moneths after Dilation in manner forefaid; But prejudice aiwayes to any other perfon who fliall difcover the contraveeners, and furnifli probation againlt them, of the one half of the penalties , whenfoever they fliall difcover them , they being aiwayes difcovered and found guky , within the time and in manner forefaid. AND it is hereby DECLARED, That this prefent Act, is, and lhall be in place of any former fumptuary Law, in relation to Apparel. ACT
