Be it enacted by the Senate and House of Representatives of the United Jessie amen me States of America in Congress assembled, That the claim of Jessie Ben- ""f,'}§,,,,, ,.8,-6,,,, ,0 ton Fremont to certain lands, and the improvements thereon, at Port Court of Ohms. San Jose, in San Francisco, State of California, and her claim for compensation for the taking, use, and occupation thereof, be referred to the Court of Claims to hear and determine the same to judgment, notwithstanding the lapse of time, with right of appeal as in other cases. The said Jessie Benton Fremont, her heirs, assigns, or legal representatives, shall commence their action in said Court of Claims by petition, filed within six months from the passage of this act, and the said court is hereby directed to ascertain concerning the ownership or claim in law or equity of the said Jessie Benton Fremont, her heirs, assigns, or legal representatives, to the said land; also the facts constituting the ownership or claim in law of the United States thereto. Said court shall also ascertain and determine the value of said lands at the time they were taken by the United States for military purposes and the value of all improvements thereon. It shall also ascertain and determine the present value of said lands and what would be fair compensation for the use and occupation thereof from the time they were taken by the Government to the date of the tindin g by the court and report its judgment as to the sum that should be paid said Jessie Benton Fremont in full payment for the taking and use of said lands by the United States.
