That said lands shall be forfeited to the United States if · within three years from the passage hereof the said city has not begun to use them for the purposes granted, or if at any time the city shall fora period of three years cease to use the same for such purposes. That the following described tract of land, situate in the county of ltolette, State of North Dakota, namely, the south half of northwest quarter of section thirty, township one hundred and sixty- two north, range seventy-two west, be, and the same is hereby, granted and conveyed to the Lake Schutte Cemetery Corporation, of Dunseith, iNorth Dakota, téo have and to hold said lands to its use and behoof orever or ceme ery purposes. Sec. 6. That the northwest quarter of the northwest quarter of section thirty, township seventeen north, ran e three east, Black Hills meridian, is hereby granted to the Nashville Presbyterian Church, of Nashville, South Dakota, for cemetery purposes; and the trustees of said church and their successors in office are hereby authorized and _ empowered to sell or convey lots to any person at such price as they §;°5;';;_m_ shall dx for the same for burial purposes: Provided, That there was no prior legal claimant upon said land at the time it was first used for cemetery purposes.
