Upon application t o the Secretary of the Interior, and Extension of expired subject to valid intervening rights and to the provisions of section 1 permits . of this Act, any permit which has already expir ed because of lack of authority under existing law to make further extensions, may be extended for a period of three years from the date of this Act . Resolved by the Senate and House of Representatives of the United States of America in Congress assembled, That sec ti on 3 Mount Vernon Me . moral Highway, Va . of the Act entitled "An Act to authorize and direct the survey, Vol .45,p .721,amend- construction, and maintenance of a memorial highway to connect edPost, p .1563 . Moun t Ve rno n, in the S tate of Vir gini a, with the Arlington Memorial Bridge across the Potom ac Riv er at Washi ngton, " appr oved May 23, 1928 (Forty-fifth Statutes at Large, pages 721, 722), be, and the same hereby is, amended by the add itio n of the following language : "an d to mak e such lands whi ch wo uld be in Improvement of added lands . harmony with the District of Columbia river and harbor plan of Vol-22,p.198. the War Department, pursuant to the Act of August 2, 1882 ." Condemnation of SEC. 2. That section 4 of said Act be, and the same h ereby is, lands in Virginia . amended by striking out that part of said section which reads : edvol .45,p.722,amena- " Whenever it be com es necessary to ac qui re by co nde mnat ion Matter stricken out . proceedings any lands in the State of Virginia for the purpose of carrying out the provisions of this Act, such proceedings shall conform to the laws of said State now in force in reference to Federal condemnation proceedings," and by substituting in lieu Matter substituted. thereof the following : "Whenever it becomes necessary to acquire Proc eed ing s un der by condemnation proceedings any lands in the State of Virginia State law . for the purp ose of c arry ing out the provisions of this Act, such proceedings shall conform as near as may be to the proceedings authorized by chapter 472 of the 19 28 acts of the General Assembly of Virginia (acts of the 1928 Gene ral Assembly of Virginia, pages 1228-1230), empowering the State h ighway commissioner of Virginia to co nde mn la nds for Sta te hi ghw ay purposes : Provided further, Provisos. That in addition to the exercise of the power of eminent domain condemnaEon bOfOie as hereinbefore provided, the Secr etary of Agriculture is hereby authorized to enter upon and take possession of such lands and rights of ways as he may dee m ne cess ary for the purp oses of this Act and to proceed with the constr uction of such highway over and through such lands without having first condemned the same : Provided, however, That within sixty days after taking possession psession to e n after of such lands and rights of way, if the United States and the owner or owners thereof have been unable to agree upon just compensation therefor , condem nation p roceedin gs shall be insti tuted a s hereinabove provided : Provided further That if title to any land s or int erest Possession where ad- verse title claimed, and therein, required for the purposes of this Act, is claimed by the con str uct ion to pr o- United States and by other persons or corporations and the controversy between the United States and such persons or cor- porations as to the ownership of su ch lands threatens delay in the constr uction or com pletion of sai d highway, the Secretary of Agriculture is hereby authorized to enter upon and take possession of such lands, title to which is in dispute between the United States and others, and to proceed wi th the construction of the highway over and through the same, while appr opriate proceedings to
