687 SEC. 303 . COUNTERVAILING DUT IES .

SPECIAL PROVISIONS . Countervailing du- When ever Whenever any country, dependency, colony, province, or other ties Levied on imports re- political subdivision of government, person, partnership, association, ceiving, etc ., bounty if manufactured abroad, cartel, or corporation shall pay or bestow, directly or indirectly, any etc . bounty or grant upon the manufacture or production or export of any article or merchandise manufactured or produced in such coun- try, dependency, colony, province, or other political subdivision of government, and such article or merchandise is dutiable under the provisions of this Act, then upon the importation of any such article or merc hand ise into the Uni ted Stat es, whet her the same sha ll b e imported directly from the country of production or otherwise, and whether such article or merchandise is imported in the same condi- tion as when exported from the country of production or has been changed in condition by remanufacture or otherwise, there shall be levied and paid, in all such cases, in addition to the duties otherwise imposed by this Act, an additional duty equal to the net amount of eq al bounty, du yto such bounty or grant, however the same be paid or bestowed . The Secretary of the Treasury shall from time to time ascertain and Ascerton

The Secretary of the Treasury shall make all regulations he may deem necessary for the identification of such articles and merchandise and for the assessment and collection of such additional duties . SEC. 304. MARKING OF IMPORTED ARTICLES . (a) MANNER OF MARKING .-Every article imported into the United States, and its immediate container, and the package in which such article is imported, shall be marked, stamped, branded, or labeled, in legible English words, in a conspicuous place, in such manner as to indicate the country of origin of such article, in accordance with such regulations as the Secretary of the Treasury may prescribe . Such marking, stamping, branding, or labeling shall be as nearly indelible and permanent as the nature of the article will permit . The Secretary of the Treasury may, by regulations prescribed here- under, except any article from the requirement of marking, stamp- ing, branding, or labeling if he is satisfied that such article is incapa- ble of being marked, stamped, branded, or labeled or can not be marked, stamped, branded, or labeled without injury, or except at an expe nse econ omic ally pro hibi tive of the impo rtat ion, or that the marking, stamping, branding, or labeling of the immediate con- tainer of such article will reasonably indicate the country of origin of such article . (b) ADDITIONAL DuTU S FOR FAILURE TO MARK .-If at the time of impo rtat ion any arti cle or i ts c onta iner is not mark ed, stam ped, branded, or labeled in accordance with the requirements of this section, there shall be levied, collected, and paid on such article, unless exported under customs supervision, a duty of 10 per centum of the value of such article, in addition to any other duty imposed by law, or, if such article is free of duty, there shall be levied, col- lected, and paid a duty of 10 per centum of the value thereof . (c) DELIVERY WITHHELD UNTIL MAR K -PD .-No imported article or package held in customs custody shall be delivered until such article (and its container) or package and every other article (and its container) or package of the importation, whether or not released from customs custody, shall have been marked, stamped, branded, or labeled in accordance with the requirements of this section . Nothing in this subdivision shall be construed to relieve from the requirements of any provision of this Act relating to the marking of particular articles or their containers . Mark ing impo rted articles . Country of origin to be conspicuously marked in English on article and container imported . Character of mark- ing. Marking of container permitted . Additional duty if not marked, unless arti- cle expo rted . No delivery from cus- toms custody until arti- cle and container are mark ed .
