TITLE IV-GENERAL PROVISIONS SEC. 401. No part of any appropriation contained in this Act shall be used to pay the salary or wages of any person who engages in a strike against the Government of the United States or who is a mem- ber of an organization of Government employees that asserts the right to strike against the Government of the United States, or who advo- cates, or is a member of an organization that advocates, the overthrow of the Government of the United States by force or violence: Provided, That for the purposes hereof an affidavit shall be considered prima facie evidence that the person making the affidavit has not contrary to the provisions of this section engaged in a strike against the Gov- ernment of the United States, is not a member of an organization of Government employees that asserts the right to strike against the Gov- ernment of the United States, or that such person does not advocate, and is not a member of an organization that advocates, the overthrow of the Government of the United States by force or violence: Provided further, That any person who engages in a strike against the Govern- ment of the United States or who is a member of an organization of Government employees that asserts the right to strike against the Government of the United States, or who advocates, or who is a member of an organization that advocates, the overthrow of the Government of the United States by force or violence and accepts employment the salary or wages for which are paid from any appropriation contained in this Act shall be guilty of a felony and, upon conviction, shall be fined not more than $1,000 or imprisoned for not more than one year, or both: Provided further, That the above penalty clause shall be in addition to, and not in substitution for, any other provisions of existing law. SEc. 402. This Act may be cited as the "First Deficiency Appropria- tion Act, 1947". Approved May 1, 1947. AN ACT To amend the Act of January 5, 1905, to incorporate the American National Red Cross. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the Act to incorporate the American National Red Cross, approved January 5, 1905, is hereby amended by inserting the following paragraph imme- diately following the second paragraph of the said Act: Whereas the said treaty has been revised and extended by a treaty or convention for the amelioration of the condition of the wounded and the sick of armies in the field, signed at Geneva, July 27, 1929, and adhered to by the United States of America, effective August 8, 1932; and". SEC. 2. The fourth paragraph of the Act to incorporate the Amer- ican National Red Cross is hereby amended to read as follows: "Whereas a permanent organization is an agency needed in every nation to carry out the purposes of said treaties, and especially to secure supplies and to execute the humane objects contemplatedby said treaties, with the power to adopt and use the distinctive flag 80 [61 STAT.
