To amend the Republic of South Africa Constitution Act, 1961, to further regulate the division of the provinces into electoral divisions; and to provide for matters connected therewith.

Be it enacted by the State President, the Senate and the House of Assembly of the Republic of South Africa, as follows:―

Amendment of section 43 of Act 32 of 1961, as substituted by section 3 of Act 83 of 1965 and amended by section 83 of Act 79 of 1973.

1. Section 43 of the Republic of South Africa Constitution Act, 1961, is hereby amended by the substitution for subsections (1) and (2) of the following subsections:

“(1) For the purposes of any division of the [Republic] provinces into electoral divisions, the quota of [the Republic] each province shall be obtained by dividing the number of white voters in the [Republic] province, in terms of the current voters’ lists, duly corrected up to the latest possible date, by [one hundred and sixty-five] the number of members of the House of Assembly to be elected therein in terms of section 40.

(2) [The Republic] Each province shall be divided into electoral divisions in such a manner that each such division shall, subject to the provisions of subsection (3), contain a number of voters as nearly as may be equal to the quota of the [Republic] province.”.

Short title and commencement.

2. This Act shall be called the Republic of South Africa Constitution Third Amendment Act, 1980, and shall come into operation on 1 April 1980.
