THE REPRESENTATION OF THE PEOPLE (AMENDMENT)
ACT, 1991

An Act further to amend the Representation of the People Act, 1951.
Be it enacted by Parliament in the Forty-Second Year of the Republic of India as follows:—
Short title and commencement. 1.—(1) This Act may be called the Representation of the People (Amendment) Act, 1991.
(2) It shall be deemed to have come into force on the 18th day of April, 1991.
Substitution of new section for section 73A and 73AA. 2. In the Representation of the People Act, 1951. (hereinafter referred to 43 of 1951. as the principal Act), for sections 73A and 73AA, the following section shall be substituted, namely:—
Special provision as to certain elections. "73A. Notwithstanding anything contained in Section 73 or in any other provision of this Act, with respect to the general election for the purpose of constituting a new House of the People open upon dissolution of the Ninth House of the people,—
(a) the notification under Section 73 may be issued without taking into account the Parliamentary constituencies in the State of Jammu and Kasjmir; and
(b) the Election Commission may take the steps in relation to elections from the Parliamentary constituencies in the state of Jammu and Kashmir separately and in such manner and on such date or dates as it may deem appropriate."
Repeal and saving. 3. (1) The Representation of the People (Amendment) Ordinance, Ord 2. of 1991. 1991 is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action-taken under the principal Act, as amended by the said Ordinance, shall be deemed to have been done or taken under the principal Act, as amended by this Act.

- any judgement or order of a court, Tribunal or other judicial authority, unless the reproduction or publication of such judgement or order is prohibited by the court, the Tribunal or other judicial authority, as the case may be.
The decision of the Supreme Court of India in "Eastern Book Company & Ors vs D.B. Modak & Anr" on 12 December, 2007 interpreted this section of the Act as making the material public domain.
