Amending the Penal Code (No. 12),
2535 BE

Being the 47th year of the present reign
Phra Bat Somdet Phra Paramin Maha Bhumibol Adulyadej gives a great royal command by which He orders with His pleasure that it be announced as follows:
Whereas it is appropriate to amend the Penal Code;
Therefore, by and with the advice and consent of the National Legislative Assembly acting as the National Assembly, He orders with His gracious pleasure that the following Act be enacted:
Section1.This Act is called the "Act Amending the Penal Code (No. 12), 2535 BE".
Section2.This Act shall come into force from the day following the day of its publication in the Royal Gazette onwards.
Section3.The stipulations of section 266 of the Penal Code shall be repealed and replaced by the following stipulations:
"Section266.Whoever forges [any of] the following documents:
(1)right documents which are official documents;
(2)testaments;
(3)stock certificates, debentures, or stock or debenture warrants;
(4)bills; or
(5)certificates of deposit;
shall be punished with imprisonment from one year to ten years and a fine from twenty thousand baht to two hundred thousand baht."

Note: The grounds for promulgation of this Act are as follows: Whereas commercial banks under the law on commercial banks, as well as finance companies under the law on the practice of financing business, security business, and crédit foncier business, now accept deposits by means of issuing certificates of deposit, and the said certificates of deposit are negotiable instruments, it is appropriate to designate measures for prevention of forgery of the described instruments in order to protect common interest which may injured by the use of forged certificates of deposit. Therefore, it is necessary to enact this Act.
