Act Implementing Safeguards for the Constitution,
2476 Buddhist Era

Phra Bat Somdet Phra Paramin Maha Prajadhipok Phra Pok Klao Chaoyuhua gives a great royal command by which He declares to all the following order:

Whereas the House of People’s Representatives has advised Him that it is appropriate to implement safeguards for the sanctity of the Constitution;

Therefore, He permits, by and with the advice and consent of the House of People’s Representatives, the enactment of the following Act:

Section1.This Act shall be called the Act Implementing Safeguards for the Constitution, 2476 Buddhist Era.

Section2.This Act shall come into force from the day of its publication in the Royal Gazette onwards.

Section3.Whoever commits any act which is hostile to, or with a view to causing the people to lose appreciation of or have apprehension in, the administrative regime under the Constitution of the Kingdom of Siam, is hereby declared to be guilty of an offence for which he shall be punished with imprisonment of three years up to twenty years, or a fine of five hundred baht up to five thousand baht, or both the imprisonment and the fine, even though the said act is merely a conspiracy, or agreement, or preparation.

However, if the offence committed also comes under a different provision of law, it is hereby declared that the offender be punished in accordance with such different law or ordinance also.

Section4.For the sake of public order, when an authority from the Ministry of Interior reports that any person carries out an act which would bring about the offence under section 3 above, the Ministry of Interior shall refer the matter to a Committee to be established by the Cabinet for examination and ruling. If it is found to be well-grounded, an opinion shall be rendered that the person be kept within a limited area for a term of not over ten years, and the Ministry of Interior shall have the power to give orders for the implementation of such opinion.

If the alleged offender is an alien, it is hereby required that he be dealt with in accordance with the Deportation Act, 131 RE.

Section5.The Committee under section 4 must be composed of judicial public officials, who shall be at least three in number in order to sit as a quorum. Their rulings shall adhere to the majority opinion.

Section6.A person who has been ordered to be kept within a limited area and has already entered the area as ordered may later request the Ministry of Interior to consider revoking such order after he agrees to guarantee that—

  1. he will cease to be hostile to the administrative regime under the Constitution;
  2. he will wholeheartedly propagate and support the administrative regime under the Constitution.

When the Ministry of Interior has demanded a secured bond and ruled that the alleged offender is clearly seen to be able to follow what he has agreed to guarantee, it shall propose to the Cabinet to approve the revocation of the original order.

Announced on the 5th day of November 2476 Buddhist Era, being the 9th year of the present reign.
