Re: Amendments to the Announcement of the Council for Democratic Reform No 15 dated the 21st day of September 2549 Buddhist Era


Following the issuance of the Announcement of the Council for Democratic Reform No 15 dated the 21st day of September 2549 Buddhist Era which orders the Organic Act on Political Parties, 2541 BE to remain in force, the effect of the said law needs to be clarified and the disfranchisement of the persons involved in the acts prohibited by such law needs to be stipulated, for which reason the Council for Democratic Reform announces as follows:

Article1.The provisions of article 1 of the Announcement of the Council for Democratic Reform No 15 dated the 21st day of September 2549 Buddhist Era shall be repealed and replaced by the following provisions:

Article1.The repeal of the Constitution of the Kingdom of Thailand shall not affect the Organic Act on Political Parties, 2541 BE. The Organic Act on Political Parties, 2541 BE shall remain in force until amended or repealed by a law.”

Article2.The prohibition of the conduct of any meetings or activities by political parties according to the Announcement of the Council for Democratic Reform No 15 dated the 21st day of September 2549 Buddhist Era shall remain in effect until a different resolution is adopted by the Cabinet.

Article3.In the event that the Constitutional Court or a different organisation serving as the Constitutional Court orders dissolution of any political party because of having committed an act prohibited by the Organic Act on Political Parties, 2541 BE, it shall disfranchise the members of the executive committee of such political party for a period of five years from the day the dissolution of the political party is ordered.

Article4.Whoever has been disfranchised by a court order under the Organic Act on Elections of Members of the House of People’s Representatives and Senate, 2541 BE since before the effective day of the Announcement of the Council for Democratic Reform No 3 dated the 19th day of September 2549 Buddhist Era shall remained disfranchised according to the court order.
