Paragraph 1- If one borrowed a cow without specification, and the borrower’s ox damaged the owner’s, even if the borrower’s cow was an unwarned-cow, he would still pay for the full damage because had the cow been damaged from a third party’s ox, he would need pay given that in a standard case the borrower must watch it so that it does not harm or get harmed. If the borrower only accepted to watch that it not damage others but not that it not be damaged by others, and the borrower’s ox damaged it, if the ox was an unwarned-animal it would pay half the damages, and if it was a warned-animal, it would pay the full damage. If the owner’s ox damaged the borrower’s ox, and the borrowing was without specification, the owner would be exempt, whether it was an unwarned-animal or a warned-animal. If the animal damaged a third party’s ox, the borrower would need to pay because he has the responsibility to watch it so that it does not damage others. If the borrower accepted to watch it from damaging others but not that it not be damaged, and the animal damaged the borrower’s ox, the owner would pay half the damage in the case of an unwarned-animal and the full damage in the case of a warned-animal.
