Being the 53rd year of the present reign

Phra Bat Somdet Phra Paramin Maha Bhumibol Adulyadej gives a great royal command by which He orders with His pleasure that it be announced as follows:

Whereas it is appropriate to amend the law on Thammasat University;

Therefore, by and with the advice and consent of the National Assembly, He orders with His gracious pleasure that the following Act be enacted:

Section1.This Act is called the "Thammasat University Act (No. 2), 2541 BE".

Section2.This Act shall come into force from the day following the day of its publication in the Royal Gazette onwards.

Section3.The stipulations of section 12 of the Thammasat University Act, 2531 BE, shall be repealed and replaced by the following stipulations:

"Section12.Apart from the money designated in the national budget, the income of the University may include the following:

(1)benefit money, fees, fines, and service charges which belong to the University;

(2)the money and property which are dedicated to the University;

(3)income or benefit which is obtained from the use of the crown land administered, taken care of, or utilised by the University;

(4)other income or benefit.

The University shall have the power to administer, take care of, maintain, use, and seek benefit from the property of the University, whether it be the crown land according to the law on crown land or other property.

The income of the University, as well as the penalties accruing from the execution of the objectives of the University, but not including the penalties accruing from breaches of academic leave contracts and the penalties accruing from breaches of property purchase contracts or hire-of-work contracts carried out using budgetary money, shall not be the income which must be sent to the Ministry of Finance according to the law on treasury reserve and the law on budgetary procedure."

Section4.The following stipulations shall be inserted in the Thammasat University Act, 2531 BE, as section 12bis:

"Section12bis.All immovable property obtained by the University through dedications made by anyone or through purchase or exchange using the income of the University shall not be considered crown land and shall be subject to the ownership of the University."

Section5.The provisions of section 12bis of the Thammasat University Act, 2531 BE, as amended by this Act, shall not apply to all immovable property obtained by the University through dedications made by anyone or through purchase or exchange using the income of the University prior to the day of coming into force of this Act.

Section6.This Subminister of Universities shall be in charge of the execution of this Act.

Note:The reasons for promulgation of this Act are as follows: Whereas it is appropriate to enable the University to use its income in its own affairs without having to send it as national income and to enable the University to hold ownership over the immovable property obtained through dedications made by anyone or through purchase or exchange using its income, without requiring the property to be regarded as crown land, for the sake of the flexibility of the University in managing its own affairs and seeking benefit from the immovable property it administers, takes care of, or utilises, it is therefore necessary to enact this Act.
