ORDINANCE
NUMBER 39
5 January 1945
REGULATIONS OF FOREIGN TRADE

SECTION Ⅰ. The transportation of all property including goods or valuables of any kind to or from Korea by air, land or by water is prohibited except by persons duly authorized to perform such function by the Military Governor or by such agency or agencies as may be designated by him as the authorized agent of the Military Government of Korea.

SECTION Ⅱ. The transportation of all property including goods or valuables of any kind to and from Korea by air, land or by water is prohibited where transported by any airplane, boat, cart, vehicle or mechanical conveyance of any kind except in these cases where such airplane, boat, cart, vehicle or mechanical conveyance is duly licensed for such purpose by the Military Governor or by such agency or agencies as may be designated by him as the authorized agent of the Military Government of Korea.

SECTION Ⅲ. The transportation of all property including goods or valuables of any kind to and from Korea is prohibited where transported on the person of the traveler or upon any animal or animals controlled by him except in those cases where such person is duly authorized to transport such goods to or from Korea by the Military Governor or by such agent or agencies as may be designated by him as the authorized agent of the Military Government of Korea.

SECTION Ⅳ. The transportation of all property including goods or valuables of any kind to and from Korea is prohibited except by way of such ports or airports entry as may from time to time be designated as open ports by the Military Governor or by such agent or agencies as may be designated by him for this purpose.

SECTION Ⅴ. All property including goods or valuables of any kind found in the course of unauthorized transportation to or from a foreign country shall be considered as contraband and shall be turned over by the apprehending authority to the custody of Military Government of Korea, to be disposed of in accordance with existing provisions relative to the sale or other disposition of government property.

SECTION Ⅵ. Any private vessel, airplane, cart, animal, motor, vehicle or nay other conveyance or instrumentality not owned by any government which is utilized in violation of this ordinance shall upon the conviction of the violator or violators be turned over to the custody of the Military Government to be disposed of in accordance with the existing provisions relative to the sale or other disposition of government property. such instrumentalities may be impounded by the apprehending agency pending the outcome of the trial.

SECTION Ⅶ. This ordinance does not apply to the transportation of the personal effects of any officer or employee of the Military Government of Korea or of the United States. It shall not be construed to apply to the transportation of the personal effects, goods or valuables of any persons subject to the military or naval laws of the United States or any of the United Nations nor shall it be construed as a prohibition of the transportation to or from Korea of the personal effects goods or valuables of persons duly authorized to enter or depart from Korea under repatriation programs approved by the Military Government of Korea or of any persons in the course of performance of official business or such such Government.

SECTION Ⅷ. In the ordinance "Korea" Means all of the area of Korea subject to this command.

SECTION Ⅸ. Any person violating the provisions of this ordinance shall, upon conviction by a Military Occupation Court, suffer such punishment as the court shall determine

SECTION Ⅹ. This ordinance is effective 2400, 12 January 1946.
