Chap. CXXX.—An Act in relation to the district court for the northern district of New York.[1]
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,Clerk of the court may appoint a deputy. That it shall be lawful for the clerk of the district court for the northern district of New York, to appoint a deputy, who, in his absence, may exercise all the official powers of the said clerk, at the village of Auburn, in the county of Cayuga, in the said district.Deputy to take an oath. And such deputy, before he enters on the discharge of his duties, shall take the usual oath for the faithful performance of his duties as such deputy.Clerk responsible for acts of his deputy. And nothing herein contained shall be held to excuse or release the said clerk from legal responsibility for acts performed by his said deputy, in behalf of said clerk in the office aforesaid.
