The Constitution Thirteenth Amendment Act of 2007 is an act of the Parliament of South Africa amending the Constitution of the Republic of South Africa, 1996. It came into force 14 December 2007, and re-enacted the determination of the Eastern Cape/KwaZulu-Natal provincial boundary first enacted in the Constitution Twelfth Amendment Act of 2005.

One of the changes in the Twelfth Amendment Act was to transfer the Matatiele area from KwaZulu-Natal to the Eastern Cape. The people of Matatiele objected to this change, and won a Constitutional Court ruling that the boundary changes were unconstitutional because the KwaZulu-Natal provincial legislature had not allowed for proper public consultation. The ruling was, however, suspended for 18 months to allow the government to repeat the amendment process with proper consultation. The result of that process was the Thirteenth Amendment Act.

Act

To amend the Constitution of the Republic of South Africa, 1996, so as to correct invalid provisions inserted into the Constitution; and to provide for matters connected therewith.

Be it enacted by the Parliament of the Republic of South Africa, as follows:—

Amendment of Schedule 1A to the Constitution of the Republic of South Africa, 1996, as inserted by section 4 of the Constitution Twelfth Amendment Act of 2005

1. Schedule 1A to the Constitution of the Republic of South Africa, 1996, is hereby amended by—

(a)

the substitution for the determination of the geographical area of the Province of the Eastern Cape of the following determination:

“The Province of the Eastern Cape

Short title

2. This Act is called the Constitution Thirteenth Amendment Act of 2007.
