Official texts

In general, all official texts originally published in English, or officially translated into English, are eligible to be imported to English Wikisource under {{PD-EdictGov}}. However, depending on whether the source scan is copyrighted in its original country or not, the source scan should be uploaded to English Wikisource locally, or on Wikimedia Commons.

Official texts, as defined in Article 2(4) of the Berne Convention for the Protection of Literary and Artistic Works, are texts of a legislative, administrative and legal nature and the official translations of such texts.

Works should be tagged with a template that identifies their license status according to Wikisource's copyright policy. See Help:Copyright tags for a list of templates for works which are not official documents.

Many official texts are considered to edicts of government, and are not copyrightable in the United States. Wikisource has a general template for pages that meet this criteria, however a more specific template should be used in order to inform the reader if the official text is also public domain in the country of origin.

Such documents include "legislative enactments, judicial decisions, administrative rulings, public ordinances, or similar types of official legal materials" as well as "any translation prepared by a government employee acting within the course of his or her official duties."

These do not include works of the Organization of American States, United Nations, or any of the UN specialized agencies. See Compendium III § 313.6(C)(2) and 17 U.S.C. 104(b)(5).

A non-American governmental edict may still be copyrighted outside the U.S. Similar to {{PD-in-USGov}}, the above U.S. Copyright Office Practice does not prevent U.S. states or localities from holding copyright abroad, depending on foreign copyright laws and regulations.

Australia

This work is in the public domain in Australia and possibly other jurisdictions. This is because it is a work of an Australian government (Commonwealth, State or Territory) and was published more than 50 years ago (before 1974). The copyright has therefore expired.

The government of Australia has declared that the expiration of Crown Copyrights applies worldwide. This has been confirmed by correspondence received in OTRS ticket#2017062010010417.

Canada

This work is in the public domain worldwide because it was prepared or published by or under the direction or control of the Canadian Government or any government department prior to 1974.

Section 12 of the Canadian Copyright Act provides a reservation for Crown rights or privileges. Lack of modern case law on the subject makes it unclear whether perpetual prerogative rights over these documents still apply, or whether these rights have lapsed. Notwithstanding, these documents are reproducible under the terms of the Reproduction of Federal Law Order.

According to the Supreme Court of Canada, Law Society of Upper Canada v. CCH Canadian Limited, paragraph 35, court decisions are not covered by copyright.

The federal government references judicial decisions in the Reproduction of Federal Law Order, suggesting that they are protected by either Crown Copyright or Crown rights or privileges. Crown Copyright affects documents produced later than 1973. No evidence has been found that any Crown rights or privileges exist in judicial decisions.

Hong Kong

This work is a Hong Kong ordinance, which is copyrighted in Hong Kong for 50 years after publication pursuant to section 183(2) and paragraph 36 of Schedule 2 of the Copyright Ordinance (Cap. 528). However, as an edict of a government, it is in the public domain in the U.S.


According to Section 3 of the Interpretation and General Clauses Ordinance (Cap. 1), the term "ordinance" also includes any subsidiary legislation made under any ordinances of Hong Kong that does not contravene with the Hong Kong Basic Law.

This work is the work of Government of India. Section 52(1)(q) of the Indian Copyright Act, 1957 allows for the reproduction or publication of

  • any matter which has been published in any Official Gazette except an Act of a Legislature;
  • any Act of a Legislature subject to the condition that such Act is reproduced or published together with any commentary thereon or any other original matter;
  • the report of any committee, commission, council, board or other like body appointed by the government if such report has been laid on the Table of the Legislature, unless the reproduction or publication of such report is prohibited by the government;
  • any judgement or order of a court, Tribunal or other judicial authority, unless the reproduction or publication of such judgement or order is prohibited by the court, the Tribunal or other judicial authority, as the case may be.

The decision of the Supreme Court of India in "Eastern Book Company & Ors vs D.B. Modak & Anr" on 12 December, 2007 interpreted this section of the Act as making the material public domain.

Indonesia

This work is is in the public domain in Indonesia since it falls within the exemptions to copyright protection in Article 42 of the Law of The Republic of Indonesia Number 28 of 2014 on Copyrights as a:

  1. result of an open meeting of a government institution;
  2. law or regulation;
  3. government speech or speech of a government official;
  4. court decision or judicial provision; or
  5. scripture or religious symbol.

An additional license tag is required in order to demonstrate why this work is freely licensed or in the public domain in the United States. Works that are in the public domain in Indonesia under the provisions of Article 42 b, c, or d will usually also be in the public domain in the United States as an edict of government, and may be tagged with {{PD-EdictGov}}. Works that are in the public domain in Indonesia under the provisions of Article 42 a may also qualify as an edict of government, but individual determination of copyright status is needed for each work in this category.

Ireland

This work is in the public domain because it is an official work of the Irish Government or Oireachtas. According to Chapter 19, §191-193 of the Copyright and Related Rights Act, 2000, copyright has expired in Ireland for works that are:

  1. a work made by an officer or employee of the Irish Government or State in the course of his or her duties, created before 1st January 1974; or
  2. a work made by an officer or employee of either House of the Oireachtas in the course of his or her duties, created before 1st January 1974; or
  3. a sound recording, film, live broadcast or live cable programme of the proceedings of either House of the Oireachtas created before 1st January 1974; or
  4. an Act of the Oireachtas or regulation of the Government of Ireland made available to the public before 1st January 1974.

Paragraph 6

Shall not be objects of copyright:
  • official documents of state government agencies and local government agencies of municipal formations, including laws, other legal texts, judicial decisions, other materials of legislative, administrative and judicial character, official documents of international organizations, as well as their official translations;
  • state symbols and signs (flags, emblems, orders, banknotes, and the like), as well as symbols and signs of municipal formations;
  • works of folk art (folklore), which don't have specific authors;
  • news reports on events and facts, which have a purely informational character (daily news reports, television programs, transportation schedules, and the like).

According to interstate and international compacts, the Russian Federation is the legal successor of the Russian Soviet Federative Socialist Republic and the Union of Soviet Socialist Republics; therefore, this license tag is also applicable to official symbols and formal documents of the Russian SFSR and the USSR (union level. (The union level means that use of official symbols and the formal documents of 14 other Soviet Republics is the subject of law of their legal successor.)

This license tag cannot be applied to proposed official symbols and drafts of formal documents, which can be copyrighted.

Serbia and Montenegro

This work is in the public domain because according to the Copyright Law of Serbia and Montenegro ("Службени гласник СЦГ", бр. 61/2004), "work is not copyrighted if the work is:

  1. Law, sub-law act or other kind of law act.
  2. Official materials of state authorities or materials published by any other person or institution which do public function.
  3. Official translations of materials of state authorities or translation of materials published by any other person or institution which do public function.
  4. Any of acts in judgement processes."

Hence it is assumed that this work has been released into public domain. This federal law applies for both republics, Serbia and Montenegro, as long as they do not adopt own inherent laws.

Singapore

This work was created and first published before January 1, 1989 in South Africa and is in the public domain there because it is a speech of a political nature or a speech delivered in the course of legal proceedings.

According to the Copyright Act, 1978, § 12 (8) (a), "No copyright shall subsist [...] in speeches of a political nature or in speeches delivered in the course of legal proceedings."


This work is also in the public domain in the United States because it was first published outside the United States (and not published in the U.S. within 30 days), and it was first published before 1989 without complying with U.S. copyright formalities (renewal and/or copyright notice) and it was in the public domain in South Africa speech on the URAA date (January 1, 1996). This is the combined effect of South Africa speech having joined the Berne Convention in 1928, and of 17 USC 104A with its critical date of January 1, 1996.

The critical date for copyright in the United States is January 1, 1989.


This work may be in the public domain in countries and areas with longer native copyright terms that apply the rule of the shorter term to foreign works.

South African speeches published since 1989 are not necessarily in the public domain in the United States; further information is required to determine their status in US copyright law.
