L S O it is agreed, That when a Deed, Releafe, Acquittance, or other Writing is denied in the King's Court, wherein Witneffes be named, Procefs fhall be awarded to caufe fuch Witneffes to appear, as before hath been ufed; fo that if none of them come at the great Diftrefs returned, or if ithe return- ed that they have nothing, or that they cannot be found, yet the taking of the Inqueft fhall not be de- ferred by the Abfence of fuch Witneffes. (2) And if the Witneffes do come in at' the great Diftrefs, and the Inqueft for fome Caufe remaineth untaken, the Witneffes that come in fhall have like Day given them as is afiigned for the taking of the Inqueft ; (3) at which Day, if the Witneffes do not appear, the Iftues that were firft returned upon them fhall be for- feit ; (4) and the taking of the Inqueft fhall not be deferred becaufe of their Abfence.
