D. 1663. iFarmers, fliall from and after fuch his Adting, lofe the Benefit of his faid Farm, and be thenceforth to- tally for ever difabled to be either Farmer of the faid Revenue, or Commiflioner for the Regulating there- ThePanalty. of, and exerciiing the Powers aforefaid : (4) And that all and every A6t and Al% done by any Commif- fioner or Commilfioners, or Sub-Commiflioners, being Farmer or Farmers, by him or themfelves, or jointly with others who are not Farmers, fliall be void in Law, and of none Eftedt ; (5) and that all and every Perfon or Perfons any way molefted or troubled by the Command and Authority of fuch Commiffioner or Commilfioners a6ting by him or themfelves, or together with others who are not Farmers or Commif- fioners, may bring his A6tion at Law for the fame in any of his Majefty's Courts at JVeJiminfier, and thereby recover his Damages againft any fuch Commiflioner or Commiflioners ; any Law or Statute to the contrary notwithftanding. in. And that all and every Letters Patents to be made from and after the tenth Day of April in the Year of our Lord one thoufand fix hundred fixty and three, enabling any Farmer or Farmers of the Ex- cife to be Commilfioner or Commiflioners, or Sub-Commiflioners, (hall be utterly void and of none Ef- fetS ; any Thing in any of the faid Afts to the contrary notwithftanding. iV. And that if any Commiifioner or Sub-Commiflloner, Commiflioners or Sub-Commiflioners, who by Colour. or Virtue of any Letters Patents are now both Commiflioners or Sub-Coramiffioners for regu- lating the faid Revenue, and likewife Farmers of the faid Revenue, Ihall give any falfe and corrupt Judg- men't in Advancement of the Benefit of his or their faid Farm, to the Brewers Damage, contrary to Law, he or they fliall forfeit for every fuch Judgment fo falfly and corruptly given, double Cofts to the Party fo injured by the faid corrupt and falfe Judgment : (2) And in Cafe any Perfon fliall unjuftly complain of ?ny Judgment of the Commiflioners or Sub-Commiffioners as aforefaid, and fo fliall be found upon his Appeal, the faid Party ihall forfeit double Cofts to the faid Commiflioners for fuch unjufl: Vexations, to be recovered by Information, Bill or Plaint, in any Court of Record. V. And be it further enadted by the Authority aforefaid. That from and after the firft Day of September in the Year of our Lord one thoufand fix hundred fixty and three, all and every Gager or Gagers of the Excife, who Ihall take an Account of any Beer or Ale brewed or made by any common Brewer, ftiai! weekly after fuch common Brewer hath made, or ought to have made his Entry at the Office of Excife, .and not otherwife, make and deliver to fuch common Brewer at his Houfe, or to fome of his Servants in his Behalf, a true Copy under his or their Hand of fuch Return or Report as he or they hae made thereof to the Commiflioners or Sub-Commiflioners of Excife refpedtively, upon Pain to forfeit for every NeglecT: or Refufal the Sum of forty Shillings. VL Provided neverthele's, that no fuch common Brewer or Brewers fliall be fued or profecuted for any Penalty or Forfeiture by him or them incurred, for or by reafon of any Mif-entiy or fhort Entry, if he or they fliall with'n the Space of one Week after the Delivery of fuch Copy as aforefaid, redtify his or their Entry according to the faid Return, or otherwife difcharge himfelf. VII. Be it enacled, 'That from and after die faid firft Day of Siptemher one thoufand fix hundred fixty- three, and as often as there Ihall be Occafion, two able Artifts fliall be appointed, one of them by his Majefty's Commiflioners, Farmers or Sub-Commiflioners, for Excife, and the other by the Brewers of any City or Place, which faid Artifts (hall take an Oath, which Oath any one Juftice hath hereby Power to adminifter, to take and compute thejuft Contents and Gage of all Coppers, Fats., Tuns, Backs and' .Coolers, and all other Brewing Vefl^els of that Nature, belonging to all or any Brewer or Brewers of Beer, or Ale to fell, and to deliver and give under their Hands one Copy of the particular Contents of all fuch Vefl'els to the aforefaid Commiflioners, Farmers and Sub-CommiiFioners, and another true Copy thereof to each and every fuch refpedive Brewer ; which Computation by the Artifts aforefaid fhall anfwer and 1 be according to the Meafures and Proportions expreft in the faid former Acts for Excife. , ' VIII. And be it further enadled. That no Commiffioner, Farmer or Sub-Commiflioner for the Excife, or common Brewer of Ale or Beer to fell, or Inn-keeper whatfoever, fliall from and after the faid firft Day of September' have Power to atft in or execute as a Juftice of the Peace any of the Povvers, Claufes or Things contained in any of the Laws made for and concerning the Excife, or in this prefent A6t ; and if any or the faid Perfons (hall prefume to acft or execute any Thing contrary hereunto, it is hereby further declared. That all fuch Things fo a6ted or executed by any of them, are and fliall be utterly void and- null to all Intents and Purpofes. ' IX. And whereas by the faid recited A6fs it is enacted. That no Perfon fliall be compelled by the ' Commiflioners or Sub-Commiliioners of Excife to travel for the making of his Entries, or Payment of' ' the Duties of Excife, or other Caufe whatfoever touching or concerning the fame, if he live in a Market- ' Town, out of the faid I ownj and if he live out of a Market-Town, then to no other Place tlianto

' Commiflioners and Sub-Commiflioners, or their Ofiicers, have not accordingly kept Officers in the ' Market-Towns in many Counties within England and IVales, whereby fuch Entries and Payments forJ ' the Duties of Excife might be had and made, and yet do take and levy the Penalties and Forfeitures in i| ' the faid A<5ts mentioned for Non-entry and Payment of the Duty, and do otherwife thereupon grieve ' and vex his Majefty's Subjecfts, contrary to the true Intent and Meaning of the faid Acts :' X. Be it therefore enadted by the Authority aforefaid, That from and after the faid firft Day oi September in the Year of our Lord one thoufand fix hundred fixty and three, the Commilfioners, Farmers or Sub-Com- miflioners in each County within England and Wales, fliall conftitute and appoint or depute under their Hands and Seals, fuch Perfon or Perfons as they fliall think needful in each refpedtive Market- Town, to be there upon every Market-Day, in fome known and publick Place, for the receiving of the faid Entries and Duties of Excife, and for performing all other Matters and Things touching the faid Duty, according to the faid Adts,- and this prefent Adt ; {z) ^hich faid Perfon and Perfons fo conftituted or deputed, and the Place where they intend to hold or keep fuch Office, being on the next Market-Day after fuch Conftitution of Deputation publilhed in full and open Market, fliall attend at fuch Office on every Market-Day, in fuch Market-Town, and fliall keep the faid Office open from nine of the Clock in the Morning until twelve !of the Clock at Noon, and from two of the Clock in the Afternoon iintil five of the Clock in the Afternoon,; «^?
