Penalties onCol- upon ftamped Vellum, Parchment and Paper refpedlively, into the Receipt of the Exchequer of His Ma- jefty, His Heirs and Siicceflbrs, diftinft and apart from all other IVIonies which thefaid Commiflioners fhall feveraliy receive for the Ufe of His Majefty, His Heirs or Succeflbrs. XLI. And be it further enafted by the Authority aforefaid, That there fhall be, from time to time, for ever, provided and kept in the Exchequer (that is to fay) in the Office of the Auditor of the Receipts, fe- veral Books, in which all the Monies which ought to be paid in Weekly as aforefaid, and which fhall be brought into the fame Receipt, fliall be entred apart and diftindl: from all other Monies paid or payable to His Majefty, His Heirs and Succeflbrs, upon any Account whatfoever. XLII. And be it further enadled, That if the faid Commiflioners of Excife, or the faid Commiffioners for the Duties on Vellum, Parchment and Paper for the time being refpeilively, fhall refufe or negleft to pay, or caufe to be paid into the Exchequer, all or any the Sums appointed to be paid by them feveraliy as aforefaid, in fuch Manner as they are refpeflively required by this Aft, or fhall divert or mifapply any Part of the fame, then they and every of them fo offending, fhall forfeit their feveral Offices and Places, and fhall be incapable to ferVe His Majefty, His Heirs or Succeffors, in any Office or Place of Profit or Trufi whatfoever, and fliall be liable to pay double the Value of all and every Sum and Sums of Money, fo di- verted or mifapplied, toanyPerfon orPerfons, Bodies Politick or Corporate, who fhall be intitled to any Annuity or Payment out of the Fund by this Aft fettled, and will fue for fuch Forfeiture by Aftion of Debt, or of the Cafe, Bill, Suit or Information, founded upon this Aft, in any Court of Record of His Majefty, His Heirs or Succeffors, wherein no EfToin, Proteftion, Wager of Law, or more than one Inv- parlance fhall be granted or allowed. XLIIT. And be it further enafted by the Authority aforefaid. That the Head Office of Excife, and "the Stamp Office to Chief Office for the faid Duties upon Vellum, Parchment and Paper, fhall for ever be continued, with a be for ever con- fuf£c-jent Number of Commiffioners, and a Comptroller in either of them, for performing and executing Commiffioners ^"'^'^ Matters and Things as are by this Aft enjoined to be done or performed by fuch Commiffioners and andComptroilers Comptrollers refpeftively, according to the true Meaning hereof. of the faid Du- XLIV. And be it enabled. That the refpeftive Comptrollers in the faid Offices for the time being, fliall

kee'"'d ftina '" ^^'"^ Duties upon Salt, and of or for the faid Duties upon Vellum, Parchment and Paper refpeftively, as Ac«iunts. the fame fhall from time to time arife orberaifed; to which Books all Perfons concerned fhall have free Penalty in cafe Accefs at all feafonable Times without Fee or Charge ; and if any fuch Comptroller as aforefaid, fhall negleft his Duty therein, then he or they for fuch Offence fliall forfeit his Office or Place, and be rendred incapable as aforefaid, and fhall alfb forfeit the Sum of one hundred Pounds to any Perfon or Perfons, Bo^ dy Politick or Corporate, intitled to any Annuity or Payment by this Aft, and that will fue for the fame as aforefaid. XLV. And be it further enafted. That if any Colleftor or Receiver of any the Duties by this Aft grant- leftor detaining ed upon Salt, or Rock-Salt, or of any the further Duties granted by the Aft before mentioned, for or upon Money, &c. Vellum, Parchment and Paper, fhall detain all or any Part of the Monies by him collefted or received con- trary to his Duty, then he or they for fuch Offence fhall be difmiffed from his Employment, and be charged with Intereft for the fame, after the Rate of twelve Pounds per Centum per Annum, and be liable to anfwer treble Damages to all and every Perfon and Perfons, Bodies Politick and Corporate, that fhall be grieved by fuch Detention; and if any Colleftor or Receiver of any the faid Duties upon Salt, Rock-Salt, Vel- lum, Parchment and Paper, fhall divert or mifapply all or any Part of the Monies by him collefted or re- ceived, contrary to the true Meaning of this Aft, then he or they for every or any fuch Offence fhall be difmiffed from his Employment, and rendred incapable to ferve His Majefty, His Heirs and Succeffors as aforefaid, and fhall moreover forfeit double the Sum or Sums fo by him or them diverted or mifapplied, to any Perfon or Perfons, Bodies Politick or Corporate, who fhall be intitled to any Annuity, or Payment out of the Fund by this Aft fettled, and will fue for the fame as aforefaid. i6o,oool. ontof XLVI. And be it enacT:ed by the Authority aforefaid. That Yearly and every Year, reckoning the firfl Year to begin from the nine and twentieth Day o( September, which fhall be in the Year of our Lord one thoufand fix hundred ninety-eight, the full Sum of one hundred and fixty thoufand Pounds, by or out of the Monies to arife by the faid feveral Duties, as well upon Salt, and Rock-Salt, by this Aft granted, as upon Vellum, Parchment and Paper, granted by the Aft as aforefaid, and every of them, and to e brought into the Receipt of Exchequer, by Weekly or other Payments as aforefaid (in cafe the fame Pay- ments (hall extend thereunto) fhall be the whole and entire yearly Fund ; and in cafe the faid weekly or other Payments fhall not amount to one hundred and fixty thoufand Pounds per Annum, then the faid weekly Monies or Payments, fo far as the fame will extend, fhall be Part of the yearly Fund, for and to- wards the anfwering and paying the feveral and refpeftive Annuities or yearly Payments in this Aft here- after exprefled. XLVII. And be it further enafted, That all the Sums of Money arifing by the faid feveral Duties upon Salt, Ro-k-Salt, Vellum, Parchment, and Paper, as aforefaid, which fhall be from time to time brought into the Receipt of Exchequer, or fo much thereof as fhall be fufficient to make up and compleat the faid yearly Fund of one hundred and fixty thoufand Pounds, or the proportionable Part thereof, to be payable Approprirition of in refpeft of the Monies which fhall Ije aftually advanced in purfuance of this Aft, fhall be appropriated, thefc additional fg,. apart, and applied, and the fame are hereby appropriated for and towards the raifing and making good of utiesj c. ^j^g ^^jj ygj^jy Punt], or fuch proportionable Part of the fame, and fhall be iffued and paid out of the faid Receipt of Exchequer, by the refpeftive Officers of the fame, without any Fee or Charge, and without any further or other Warrant, to be fued for, had, or obtained from His Majefty, His Heirs or Succeffors, in that Behalf, and fhall be applied to and for the Ufes and Purpofes in and by this Aft expreffed and in- Penalty on Of- tended, and to no other Ufe, Intent,, or Purpofe whatfoever ; and that the refpeftive Officers in the Exche- ficers of the quer, who fhall make any Delay in ilFuing or paying the faid Money to the faid Ufcs by this Aft intended, Sxche^uer not Qi" and for iriifap- plying any Part rhercuf. the faid addi- tional Duties, &c. to he the yearly Fund for anfwering An- nuities of S!. per Cent, to the Subfcribers of 2.000,0 ol.
