That this A£f, and all and every the Mat- ' ters and Things therein contained, be, and ftall for ever be holden and adjudged to be a fundamental ' and effential Part of any Treaty of Union to be concluded between the faid tv/o- Kingdoms; and alfo that ' this Aft fliall be inferred in exprefs Terms in any Adl of Parliament which fhall be made for fettling ^ and ratifying any fuch Treaty of Union, and fhall be therein declared to be an eflential and funda- ' mental Part thereof^ X. ^U R Sovereign Lady confidsring, That by the twenty-fecond Artrcle of the Treaty of Union, as the fame is ratified by an Aft pafled in this Selfion of Parliament, upon the fixteenth offanuary lalt, it is provided. That by virtue of the faid Treaty, of the Peers of Scotland, at the Time of the Union, fixteen fliall be of the Number to fit and vote in the Houfe of Lords, and forty-five the Num- ber of the Reprefentatives of Scotland in the Houfe of Commons of the Parliament of Great Britain; and that the faid fixteen Peers, atid forty-five Members in the Houfe of Commons, be named and chofen in fuch Manner as by a fubfequent Aft tn this prefent Seffion of Parliament in Scotland, fhould be fet- tled ; which Aft is thereby declared to be as valid, as if it were a Part of, and ingroffed in the faid Treaty: Therefore her Majefty, with the Advice and Confent of the Eftatss of Parli:imient, ftatutes, enaft-s, and ordains. That the faid fixteen PeerSj who fhall have Right to fit in the Houfe of Peers in the Parliament of Great Britain, on the Part of Scotland, by virtue of this Treaty, fhall be named by the faid Peers of Scotland, whom they reprefent, their Heirs or Succeffors to their Dignities and Honours, out of their Own Number, and that by open Eleftion and Plurality of Voices of the Peers prefent, and of the Proxies for fuch as fhall be abfent, the faid Proxies being Peers, and producing a Mandate in Writing duly figncd before V/itneffes, and both the Conftituent and Proxy being qualified according to Lavv ; declaring alfo. That uich Peers as are abfent, being qualified as aforefaid, may fend to all fuch Meetings Lifts of the Peers whom they judge fitteft, validly figned by the faid abfent Peers, which lliall be reckoned in the fa.Tie Manner as if the Parties had been prefent, and given in the faid Lift ; and in cafe of the Death, or legal : ncapacity of any of the faid fixteen Peers, that the -aforefaid Peers of Scotland fliall noininate another of their ov/n Number, in Place of the faid Peer or Peers, in Manner before and after mentioned : And that of the faid forty-five Reprefentatives of Scotland in the Houfe of Commons in . the Parliament of Great Britain, thirty fliall be chofen by the Shires or Steuartries, and fifteen by the Royal Burrows as follows, w'z. One for every Shire and Steuartry, excepting the Shires of Bute and C.iik- nefs, which fliall choofe one by Turns, Bute having the firft Eleftion ; the Shires of Nairn and Cromarty,^ . which fliall alfo ehoofe by Turns, Nairn having the firft Eleftion ; and in like Manner the Shires of 1 Clackmanan and Kinrofs, fliall choofe by Turns, Clacbnanan having the firfl: Eleftion ; and in cafe of ; ' the Death or kgal Incapacity of any of the faid Members from the refpeftive Shires or Steuartries above- ■ ■ mentioned, to fit in the Houfe of Commons, it is enafted and ordained. That the Shire or Stcuartry, ; ' who elefted the faid Member, fliall eleft another Member in his Place ; and that the faid fifteen Repre- ■ fentatives for the Roval Burrows be chofen as follows^ viz.
