C. 8. 233 Right to ele(£l and fend one Member to the Parliament of Great Britain ; and that each of the other Burghs fhall eleft a Commiflioner in the fame Manner as they are now in Ufe to eleft Commiffioners to the Parliament of Scotland, which Commiflioners and Burghs {Edinburgh excepted) being divided in four- teen Claffes or Diftrifts, fhall meet at fuch Time and Burghs within their refpedlive Diftrifts, as her Majefty, her Heirs or Succeffors fhall appoint, and eleft one for each Diftrift, viz. The Burghs of Kirkwall, Week, Dornock, Dingwall, and Taine, onej the Burghs of Fortrofe, Invernefs, Nairn, and 'Forrefs, one; the Burghs of E^-/;?, Ctillen, Barnff, Inverury, and Kintore, one; the Burghs oi Aberdeen, Jnverhervy, Montr ofe, Aberbrothock, znA Brochine, one; the Burghs of Forfar, Perth, Dundee, Coupar, and Saint Andrews, one ; the Burghs of Craill, Kilrenfiie, Anjlruther Eafter, Anjirutber JVcJler, and Pit- tenweem, one ; the Burghs of Dyfart, Kirkaldie, Kinghorn, and Bruntijland, one ; the Burghs of Inner- kithen, Dumferndine, ^eensferry, Cuhofs, and Sterling, one ; the Burghs of Glafgow, Renfrew, Ruglen, and Dumbartan, one ; the Burghs oi Haddington, Dunbarr, North Berwick, Lauder, and Jedburgh, one ; the Burghs of Selkirk, Peebles, Linlithgow, and Lanerk, one ; the Burghs of Dumfries, Sanquhar, Annan, Lockmaben, and Kirkudbright, one ; the Burghs of Wigtoun, New Galloway, Stranraver, and Whiteherny one ; and the Burghs of Air, Irvin, Rothefay, Cambletoun, and Inverary, one : And it is hereby declared and ordained, That where the Votes of the Commiffioners for the faid Burghs, met to choofe Re- prefentatives from their feveral Diftrifts to the Parliament of Great Britain, fhall be equal, in that Cafe the Prefident of the Meeting fhall have a cafting or decifive Vote, and that by and according to his Vote as a Commiffioner from the Burgh from which he is fent ; the CommiiTioner from the eldeft Burgh prefiding in the firft Meeting, and the Commiffioners from the other Burghs in their refpeftive Diflrifts prefiding afterwards by Turns, in the Order as the faid Burghs are now called in the Rolls of the Par- liament of Scotland; and that in cafe any of the faid fifteen Commiffioners from Burghs fhall deceafe or become legally incapable to fit in the Houfe of Commons, then the Town of iT^w^Kr^A, or the DiftriiSt which chofe the faid Member, fhall eleiSt a Member in his or their Place : It is always hereby exprefly provided and declared. That none fhall be capable to elecSt or be elefted for any of the faid Eflates, but fuch as are twenty-one Years of Age compleat, and Proteflant, excluding all Papifts, or fuch who be- ing fufpe£l: of Popery, and required, refufe to fwcar and fubfcribe the Forynula contained in the third Act made in the eighth and ninth Seffions of King William's Parliament, intituled, A£l for preventing the Growth of Popery ; and alio declaring, that none fliall be capable to eleft, or be elefted, to reprefeilt a Shire or Burgh in the Parliament of Great Britain, for this Part of the united Kingdom, except fuch as- are now capable by the Laws of this Kingdom, to eleft, or be elected as Commiffioners for Shires or Burghs to the Parliament of Scotland: And further her Majeftj'-, with Advice and Confent aforefaid, for the efFeftual and orderly Eleftion of the Perfons to be chofen to fit, vote, and ferve in the refpec- tive Houfes of the Parliament oS Great Britain, when her Majefty, her Heirs and Succeffors, fliall de- clare her or their Pleafure for holding the firft or any fubfequent Parliament oi Great Britain, and y/hen for that Effeft a Writ fliall be iffued out under the Great Seal of the united Kingdom, direcSed to the Privy Council of Scotland, conform to the faid twenty-fecond Article, ftatutes, enatts, and ordains. That until the Parliament oi Great Britain fliall make further Provifion therein, the faid W"rit fliall contain a Warrant and Command to the faid Privy Council, to iffue out a Proclamation in her Majefty's Name, requiring the Peers of Scotland, for the Time, to meet and affemble at fuch Time and Place within Scotland, as her Maiefly and royal Succeffors fliall think fit, to make Eleilion of the faid fixteen Peers, and requiring the Lord Clerk Regifter, or two of the Clerks of Seffion, to attend all fuch Meetings, and to adminifter the Oaths that are or fliall be by Law required, and to afk the Votes ; and having made up the Lift in the prefence of the Meeting, toreturn the Names of the fixteeji Peers chofen (cer- tified under the Subfcription of the faid Lord Clerk Regifter, Clerk or Clerks of Seffion attending) to ' the Clerk of the Privy Council of Scotland, and in like Manner requiring and ordaining the feveral Free- holders in the refpecSive Shires and Steuartries, to meet and convene at the head Burghs of their feveral i6Geo, a.c.j SJiires and Steuartries, to elecS their Commiffioners, conform to the Order above let down, and or- ' daining the Clerks of the faid Meetings immediately after the faid Eleftions are over, refpedively to- return the Names of the Perfons ele£ted to the Clerks of the Privy Council : And laftly, ordaining the. VAty oi Edinburgh to ele£t their Commiffioner, and the other Royal Burrows to elect each of them a. Commiffioner, as they have been in ufe to ele£t Commiffioners to the Parliament, and to fend the faid refpective Commiffioners at fuch Times, to fuch Burghs, within their refpeftive Diftricts, as her'Ma- jefty and Succeffors by fuch Proclamation fliall appoint; requiring and ordaining the Common Clerk of the refpeiSlive Burghs, where fuch eleclion fliall be appointed to be made, to attend the faid Meetings, and immediately after the Eleftion to return the Name of the Perfon fo eleihed (certified under his Haiul) to the Clerk of Privy Council, to the end that the Names of the fixteen Peers, thirty Commiffioners for Shires, and fifteen Commiffioners for Burghs, being fo returned to the Privy Council, may be returned to the Court from whence the Writ did iifue under the Great Seal of the united Kijigdom, conform to the faid twenty-fecond Article : And whereas by the faid twenty fecond Article it is agreed. That if her Majefty fhall on or before the firft Day of May next declare, that it is expedient the Lords and Commons of the prefent Parliament oi Englr„>d, fliould be the Members of the refpciSive Houfes of the firft Parliament of Great Britain, for and on the Part of England, they fliall accordingly be the Mem- bers of thefaid refpedtive Houfes, for and on the Part oi England ; her Majefty, v/)th Advice and Con- fent aforefaid, in that Cafe only, doth hereby ftatute and ordain, that the fixteen Peers, and forty-fiva Commiffioners for Shires and Burghs, who fliall be chofen by the Peers, Barons and Burghs rcfpeilively, in this prefent Seffion of Parliament, and out of the Members thereof, in the fame Manner as Corn- mittees of Parliament are ufually now chofen, fliall be the Members of the refpective Houfes of the Vol. IV.
