XXXVIII. And it is hereby enafted by the Authority aforefaid. Cafe be utterly incapable of being free of any City, Town, Corporation or Company, and of following incapacitated, or exercifing the intended Profeffion, I'rade or Employment; any Charter, Law or Cuftom to the con- trary notwithftanding. XL. Provided always. That nothing in this Aft contained fliall be conftrued to extend to charge any Pari(h or publick Mafter or Miftrefs with the Payment of any of the faid Duties, in Refpeft of any Money by him or her charities not received with any Apprentice or Servant, who fhall be put or placed out at the common or publick charged. Charge of any Parifli or Townfhip, or by or out of any publick Charity, or to require the ftamping with any fuch new Stamp as aforefaid, of any Indenture, Articles, Covenant, Agreement, or Contraft rela- ting to fuch Apprentice or Servant as laft mentioned; any Thing herein contained to the contrary not- withftanding. XLI. And be it further enafted by the Authority aforefaid. That if any Perfon fhall forge or counter- Forging new feit the faid new Stamps to be provided in purfuance of this Aft, or either of them, or imprefs any Vel- S'^™P' ^='°"y' lum. Parchment or Paper with any fuch counterfeit Stamp, or counterfeit any Receipt for any Monies payable by Virtue of this Aft, every fuch Perfon, being convifted of any of the Oft'ences before menti- oned, fhall be adjudged a Felon, and fufFer as in Cafes of Felony, without Benefit of Clergy. XLII. And be it further enafted by the Authority aforefaid. That every Commiffioner and OfScer, Commi.Tioners who fhall aft in or about the managing or collefting the Duties laft mentioned, and hereby granted, fhall, *° ^^ '"wotm before he fliall aft in or about the fame, take the Oath following ; that is to fay, I J. That I will faithfully execute the Truft repofed in me purfuant to the Aft of Parli- The Oath, ament, intituled, An ASifor laying certain Duties upon Candles, and certain Rates upon Monies to he given with Clerks and Apprentices, toivards raifmg her Majejifs Supply, for the Tear one thotijand /even hundred and ten, without Fraud or Concealment ; and fhall from Time to Time true Account make of my Doings therein, and deliver the fame to fuch Perfon or Perfons as her Majefty, her Heirs and Succeffors, fliall appoint to receive fuch Account; and {hall take no Fee, Reward or Profit for the Execution or Per- formance of the faid Truft, or the Bufinefs relating thereto, from any Perfon or Perfons, other than fuch as fliall be paid or allowed by her Majefty, her Heirs and Succellors, or fome other Peribn or Per- fons under her or them to that Purpofe authorized.' Which Oath fhall and may be adminiftred by any two or more of the CommifHoners laft mentioned, or any Juftice of the Peace. XLIII. And be it further enafted by the Authority aforefaid. That no Indenture or Writing required No Indenture to. by this Aft to be ftamped as aforefaid, fliall be given or admitted in Evidence in any Suit to be brought be admit.ed in by any of the Parties thereunto, unlefs fuch Party, on whofe Behalf the fame fliall be given or admitted Evidence, unlefs in Evidence, do firft make Oath, That to the beft of his or her Knowledge, the Sum or Sums therein theVnms r^eTll for that Purpofe inferted or mentioned was or were really and truly all that was direftly or indireftly pajd^ scq. given, paid, fecured or contrafted for, on Behalf or in Refpeft of fuch Clerk, Apprentice or Servant, to or for the Benefit of the Mafter or Miftrefs to or with whom fuch Clerk, Apprentice or Servant was put or placed. ^LIV. And be it further enafted by the Authority aforefaid.
