D. 1710. dred feventy-nine Pounds and ten Shillings, or fuch Proportionable Part thereof, as fhall be due, as herein To be laid be- after is mentioned; and flTall caufe the faid Eftimate or Computation to belaid before the Commons in tore the Com- Parliament aflembled, at their then Seflion (if then adtually fitting) or if the Parliament fhall not be then roi-ns, fitting, in fuch Cafe at their firft or next Seffion; to the end a good, fuificient, and effeiftual Provifion and Supply may be granted to her Majefty, her Heirs and Succeflbrs, by Parliament, for the making good for the Service of the Navy for that Year, fo much Monies as fliall, by fuch EfUmation or Computation' appear neceffary to make good fuch Deficiency, to be accordingly granted or provided : But the Delay of ma- king fuch Provifion by Parliament, as is lafl: mentioned, fhall not be any Stop or Detriment to the making good, in Manner aforefaid, the Deficiency which fhall fo happen, as aforefaid, of and for the faid Funds hereby fettled and appointed, for paying the faid annual Sum of five hundred fixty-eight thoufand two hundred feventy-nine Pounds and ten Shillings, or fuch proportionable Part thereof, as fhall be due, as herein after is mentioned, but the fame fliall be anfwered, paid, and made good in Manner, as aforefaid ; any thing herein contained, or any Law, Statute, or Uiage of the Navy, or other Matter or Thing, to the contrary in any wife notwithftanding. Cafticr of t'ne XVIII. And to the end the Treafurer or Paymafter of her Majeflry's Navy, for the time being may be Company to regularly difcharged of all fuch publick Monies, Tallies, Orders, and other Parliamentary Securities, as he to^the Tv"afu'rer °'- ^^^^ ^-"^'^ P^^ ^"'^ ^Pply towards making good any fuch Deficiency of the faid annual Sum of five of the Navy: hundred fixty-eight thoufand two hundred feventy-nine Pounds and ten Shillings, or of fuch proportion- able Part thereof, as fhall be due, as herein after is mentioned ; It is enafted. That the Treafurer or Cafliier, of the Company or Corporation to be erefted inPurfuance of this Ail, fhall from time to time give a Re- ceipt or Receipts in Writing to the faid Treafurer or Paymafter of the Navy, for all fuch publick Monies,. Tallies, Orders, and other Parliamentary Securities, as he fliall fo apply or pay towards making good fuch. Which Receipt Deficiency, as aforefaid; which Receipt and Receipts fhall be a good and fufEcient Voucher and Vouchers ftiail be admitted to the faid Treafurer and Paymafter of the Navy for the fame, and fhalf, in the PafTing of his and their as a fufficieiit Accounts, be admitted and taken accordingly by the Auditors of her Majefty's Imprefls for the Time being. Treafurer not XIX. Provided always, and be it further enafted, That if the Treafurer or Paymafter of her Majefly's paying, to incur Na^y for the Tim.e being, fhall refufe or delay to make fuch Payment and Application, as aforefaid, of any officLl""!' thV °f ^^ publick Monies, Tallies, Orders, or other publick Securities, as fhall be in his or their Hand or ] xcheouer are Hands, or Power, for or towards making good fuch Deficiency and Deficiencies of the faid annual Sum of. liable to. five hundred fixty-eight thoufand two hundred feventy-nine Pounds and ten Shillings, or of fuch propor- tionable Part thereof, as fhall be due, as herein after is mentioned, when and fo often as fuch Deficiency or Deficiencies fhall happen, fuch Treafurer and Paymafter of the Navy fhall incur the like Penalties, For- feitures, and Difabilities, as any of the Officers of the Exchequer are hereby fubjedted and made liable to for diverting or mifapplying any of the Monies, which fhall come into the Receipt of the Exchequer, upon or for the Funds hereby appointed for Payment of the faid Annuities after the Rate of fix Pounds per Centum per Annum, and to be recovered in like Manner. 56S, lygl. 10s. XX. And be it further enafted by the Authority aforefaid. That yearly and every Year for ever, reckon- to be the yearly ing the fiift Year to begin from the five and twentieth Day of December, which fliall be in the Year of our fu'id. Lord one thoufand feven hundred and fixteen, the full annual Sum of five hundred fixty-eight thoufand twO' hundred feventy-nine Pounds and ten Shillings, or fuch proportionable Part thereof as fhall be due, as is herein after mentioned, by or out of the Monies to arife by the faid feveral Duties, as well upon Salt and Rock Salt, as upon Wine, Vinegar, Tobacco, Eaji-India Goods, Raw-Silks, and other Goods and Mer- chandizes imported, granted, continued, or appropriated, and every of them, and to be brought into the Receipt of Exchequer, ip cafe the fame Payments fhall extend thereto; and in cafe the faid weekly or other Payments fhall not amount to five hundred fixty-eight thoufand two hundred feventy-nine Pounds and ten 'oKiXYmgs per Annum, or fuch proportionable Part thereof as fhall be due, as herein after is men- tioned, then the faid weekly Monies, or other Payments, fo far as the fame will extend, fhall be Part of the yearly Fund for and towards the anfwering and paying the feveral and refpeitive Annuities, or yearly Payments, in this A£t hereafter exprefTed. All the Money XXL And be it further enadted, That all the Sums of Money arifing by the faid Rates, Duties, Im- by this Aft pofitions, additional Impofitions, and Sums of Money, by this A£t granted, continued, or appropriated, granted, appro, jis aforefaid, which fhall, from time to time, be brought into the Receipt of the Exchequer, or fo much pnated for ma- tiigreof as fhall be fufficient to make up and complete the faid yearly Fund of five hundred fixty-eight veafly'rund!^ thoufand two hundred f.venty-nine Pounds and ten Shillings, or fiich proportionable Part thereof, to be due, as herein after is mentioned, fhall be appropriated, fet apart, and applied, and the fame are hereby appropriated for and towards the raifing and making good the faid yearly Fund of five hundred fixty-eight thoufand two hundred feventy-nine Pounds and ten Shillings, or f^ach proportionable Part of the fame, and fhall be iffued and paid out of the faid Receipt of Exchequer by the refpeftive Officers of the fame, as herein after is mentioned, without Fee or Charge, and without any further or other Warrant to be fued for, had, or obtained from her Majefty, her Heirs and SuccefTors, in that Behalf, and fhall be applied to and for the Ufes and Purpofes in and by this AtSt exprefi'.d and intended, and to no other Ufe, Intent, orPurpofe whatfoever; and that the refpeftive Officers in the Exchequer, who fhall make any Delay in ifiiiing or paying the faid Money to the faid Ufes by this A&. intended, or fhall be guilty of diverting or mifapplying any of the faid Monies to any other Ufe or Purpofe, contrary to this A&, for any fuch Offence, fhall be adjudged from their refpe£tive Offices and Places, and be rendred uncapable to ferve her Majefly, her Heirs and Succeffors, in any Office or Employment of Trufl or Profit whatfoever, and alfo fhall be liable to pay double the Value of any Sum or Sums fo delayed to be paid, or fo diverted or mifapplied, as aforefaid, to any Corporation, or other Perfon or Perfons that fhall be grieved thereby, and who will fue for the fame, to be recovered as aforefaid. XXII. And
