A. D. 1719- Anno fexto Georgit Regis. C. u. 287 Oaths and Affirmations fhall be adminiflred by the Guftamer or Co'icctor of the rerpe£tfve Port for fuc'i Exportation ) that then and in every fuch Cafe the faid Cuitomer or Collector fhall give to the Exporter thereof a Debenture exprefling the true Kinds and Quantities of fuch Plate and Manufactures of Silver fo exported or fhipped to be exported ; and the Exportation or Shipping thereof being certified by the Searcher upon the faid Debenture, the Collector or Receiver of the faid Duty on Plate (upon producing tiic faid Debenture fo certified to him) fhall forthwith pay a Draw-back or Allowance, after the Rate of fix Pence for every Ounce of fuch Plae or Man u failures of Silver out of the Money of the faid Duty on Plate or Manufactures of Silver then in the Hands of fuch Receiver or Collector, without Fee or Reward ; and if fuch Receiver or Collector fhall not have Money in his Hands to pay any fuch Debenture, then the re- fpe&ive Commifiioners of the faid Duty upon Plate or Manufactures of Silver, are hereby required to pay or caufe to be paid, the faid Debenture out of any the fame Duties arifing by this Act ; any Thing herein contained to the contrary notwithstanding;. . fettling a Revenue upon his Majejly in lieu thereof, or by any other Law now in Force relating to his Ma- managing theie jefty's Revenues of Excife upon Beer, Ale, or other Liquors, are provided, fettled or cftablifhed, for ma- Duties, naging, railing, levying, collecting, mitigating or recovering, adjudging, or ascertaining the Duties there- by granted, or any of them, (other than in fuch Cafes for which other Penalties or Provifions are made and prefcribed by this Act) fhall be exercifed, practifed, applied, ufed and put in Execution, in and for the managing, railing, levying, collecting, mitigating, recovering, and paying the faid Duty upon Plate or Manufactures of Silver hereby granted, during the Continuance of this Act, as fully and effectually., to all Intents and Purpofes, as if all and every the faid Powers, Authorities, Rules, Directions, Methods, Penalties, Forfeitures, Claufes, Matters and Things,, were particularly repeated and again enacted in the Body of this prefent Act. XX. And be it further enacted by the Authority aforefaid, That all Fines, Penalties and Forfeitures in AU Fines, &c relation to the faid Duty by this Ad impofed upon Plate or Manufactures of Silver, fhall be fued for, le- [° £ e ^fj^ vied and recovered, or mitigated, by fuch Ways, Means and Methods, as any Fine, Penalty, or Forfei- -*f E ^.^ ture is or may be recovered or mitigated by any Law or Laws of Excife, or by any Action of Debt, Bill, Plaint or Information in any of his Majefcy's Courts of Record at fVeJlminfter, or in the" Court of Seffion, Court of Justiciary, or Court of Exchequer in Scotland refpectively, and that one Moiety of fuch Fine, Penalty or Forfeiture, relating to the faid Duty on Plate or Manufactures of Silver, (not otherwife di- rected by this Act) fhall be to his Majefty, his Heirs and Succeffors, and the other Moiety to him or them that fhall difcover, inform or fue for the fame. XXI. Provided always, and it is hereby enacted by the Authority aforefaid, That fuch Perfons as fhall Commiflioncra be, in purfuance of this Act, appointed Commifiioners for the Duty on Plate or Manufactures of Silver, tohavethefe'Se to be made in England, Hales, or Berwick upon Tweed, fhall and may have and exercife the fame or like jutifdiftion as Jurifdiction, Power and Authority, and may adjudge, determine, mitigate, or order, in all Caufes and Commifiioners Matters relating to the faid Duties on Plate or Manufactures of Silver arifing within the Limits aforefaid, ot Exci1 -'- as the Commifiioners of Excife upon Beer, Ale and other Liquors, may or lawfully can exercife, adjudge, determine, mitigate, or order in the like Cafes or Matters in relation to the faid Duty of Excife, by any Law or Statute now in Force. XXII. And it is hereby enacted and declared by the Authority aforefaid, That all the faid Duties upon Dot J' on J? hte . Plate and other Manufactures of Silver, made or wrought in this Realm, or imported into the fame, as ►j,*'^*] VInd aforefaid, fhall be liable to and chargeable with the yearly Fund herein after mentioned, and all the An- f or Annuities, nuities to be payable out of the fame in purfuance of this Act, fubject neverthelefs to fuch Redemption as is herein after mentioned ; and all the fame Rates and Duties upon Plate and Manufactures of Silver (except the neceffary Charges before-mentioned) are and fhall be appropriated thereunto, in fuch Manner, that all the Monies which ihall, from, Time to Time, be or remain due or in arrear for and upon the fame Annuities or any of them, or for any Arrears thereof, if any fuch be, fhall from Time to Time, in the firft Place, be paid and finished out of the faid Duties upon Plate or Manufactures of Silver by this Act granted, or fo far as the fame Duties will extend, with Preference to any other Payments that fhall or may hereafter be charged thereupon, and under fuch Penalties, Forfeitures and Difabilities, as are hereafter in this Act contained in that Behalf. XXIII. And to the end all the Monies to arife by this Act for the faid Duties upon Plate and Mariii- Commiflioncrs iactures of Silver may be duly and certainly raifed and brought into the faid Receipt of Exchequer for the ? nd of T> ce 3 to Purpofes aforefaid, It is hereby further enacted by the Authority aforefaid, That from Time to Time, ^^'""be during the Continuance of this Act,, there fhall be appointed fuch and fo many Commiffioners of the. Cu- liabz/to the 5 floras and Excife, and other Officers, as fhall be proper and neceffary for the.raifing and levying the re^ Penalty of 9 & ipective Duties and Sums of Money by this Ait granted or chargeable, and for keeping and rendring the i°W. 3- c '44- Accounts of the fame ; and that all Receivers General, Collectors, and other Officers, who are or mail be concerned in the raifing, collecting, receiving and paying the faid refpective Duties hereby granted, or any of their., and keeping .arid rendring the feveral Accounts thereof, fhall perform their feveral Duties a, as to them refpectively fhall appertain, under fuch and the like Penalties, Forfeitures and Difa- bilities.. ft; any Offence or Neglect therein, or for detaining, diverting, or m,.'., .hying any Part of the faid
