A.D. 1724. or Marks, Stamp or Stamps, or fhal] in fuch Paper or Papers inclofe fuch Chocolate, as hath not been duly entred with the proper Officer, and for which the faid Inland Duties have not been duly charged or paid, with Intent to defraud his Majefty of the faid Inland Duties, for and in refpect of fuch Chocolate • that then and in every fuch Cafe, every Offender therein fhall be fubject and liable to the Penalties and Forfeitures, which by the faid Act, made in the tenth Year of his faid Majefty's Reign, are fet and im- pofed upon Perfons for counterfeiting or forging the Stamp or Stamps, Mark or Marks provided, or which fhall hereafter be provided by the Commiffioners for the faid Inland Duties for the Time being and as if fuch Offender or Offenders had actually forged or counterfeited fuch Stamp or Stamps, Mark or Marks. Damaged Choco- ' XIV. And whereas it often happens, that after Chocolate is made up for Sale and duly (lamped, as Ja e to be re- <■ t h e L aw dire£fs, it receives Damage by lying by, or otherwife becomes unfit for Sale,' Be it enacted by ftamped. ^ g Authority aforefaid, That it fhall and may be lawful, for the Owner of fi*ch ftamped Chocolate, in the Prefence of an Officer of Excife for the Divifion or Place where fuch Chocolate fhall be, to open the faid Chocolate, fo made and ftamped as aforefaid, and to deliver the faid Stamps to the faid Officer, and to work the fame Chocolate over again with frefh Cocoa-Nuts, and that fuch Owner fhall be allowed to have the Chocolate reftamped, paying the Inland Duty for fo much Chocolate as fhall be added and ufed in the New-working the fame, and no more. On reworking XV". Provided always, and be it enacted by the Authority aforefaid, That all Perfons whatever, who Chocolate Proof fhall work their Chocolate over again, fhall make Proof before the Commiffioners of the Inland Duties to be made that or t ^ e ma j or p art f them, in cafe the fame fhall be worked over again within the Limits of the Bills of bee aiT&cr' 6 Mortality, or in cafe the fame fhall be worked over again out of the faid Limits, before any two or more of his Majefty's Juftices of the Peace for the County, Divifion, Town or Place where fuch Chocolate fhall be fo worked, that all and every of his Majefty's Duties for the Cocoa-Nuts, wherewith fuch Cho- colate was made, and for vvhat COcoa-Nuts fhall be added thereunto in the reworking thereof, have been duly and fully paid, and that all the faid Chocolate fo to be reworked and reftamped had been duly entred with the proper Officers appointed for that Purpofe; and upon Failure of fuch Proof to be made, it fhall in no wife be lawful to rework and reftamp the fame. XVI. And for the more effectual difcovering and detecting the running of any Goods, Merchandizes and Commodities whatfoever, which are either prohibited to be imported, or which are liable to any Duty or Duties of Cuftoms and Excife, and Inland Duty or Duties, or to any or either of them, Be it enacted Concealing by the Authority aforefaid, That in Cafe from and after the faid twenty-fourth Day of June one thou- Goods liable to f ana feven hundred and twenty-five, any Perfon or Perfons whatfoever fhall knowingly harbour, keep or the'cood^'d concea '5 or fl*^l knowingly permit or fuffer to be harboured, kept or concealed fuch prohibited Goods treble Value? or run Goods, Wares, Merchandizes or Commodities whatfoever, liable to any Duty or Duties of Cu- ftoms, Excife and Inland Duties, or to any or either of them, the Party or Parties offending therein- vvhether he, fhe or they, have or have, not, or do or do not claim or pretend to have any Property or In- tereft in fuch Goods, Wares, Merchandizes or Commodities fo harboured, kept or concealed, fhall for every fuch Offence, forfeit and lofe all fuch Goods, Wares, Merchandizes and Commodities whatfoever fo harboured, kept and concealed, and treble the Value thereof. The Valu; of XVII. And it is hereby further enacted and declared by the Authority aforefaid, That the fingle Value Goods forfeited and Worth of fuch Goods, Wares, Merchandizes, and Commodities whatfoever fo forfeited, fhall, from to be taken ?.t Time to Time, he deemed and taken to be, according to and at the Rate and Rates, Price and Prices, as the beft Rate. ^ ^ e f(- Goods, Wares, Merchandizes, and Commodities of the like Sorts, Kinds and Denominations do- or fhall, at fuch refpective Time or Times, bear and fell for in London. XVIII. And for the better detecting and difcovering the Selling or expofingto Sale any Goods, Wares, Merchandizes or Commodities, which are or ihall be prohibited, or which have been or hereafter fhall be run, or fhall be pretended fo to have been or to be, Be it enacted by the Authority aforefaid, That in Prohibited or run cafe, from and after the faid twenty-fourth Day oijune one thoufand feven hundred and twenty-five, any Goods offered to Perfon or Perfons whatfoever fhall offer or expofe to Sale any Goods, Wares, Merchandizes or Commo- Sale may be dities whatfoever, which are or fhall be prohibited, or which actually have been or fhall be, or fhall by the feized. Party crParties fo offering or expofing the fame to Sale, be pretended to have been run, all fuch Goods, Wares, Merchandizes and other Commodities whatfoever, together with thePackage whatfoever including and con- taining the fame, fhall be forfeited, and fhall and may be feized by the Party or Parties to whom the fame fhall be fo offered or expofed to Sale, or by any Officer or Officers of Cuftoms or Excife ; Provided, that within the refpective Times next after fuch Seizure herein after mentioned, that is to fay, If fuch Seizure fhall be made in any Place or Places within the Limits of the weekly Bills of Mortality, then and in fuch Cafe, within the Space of twenty-four Hours, and if fuch Seizure fhall be made in any other Place or Places out of the Limits of the weekly Bills of Mortality, that then and in fuch Cafe, within the Space of forty-eight Hours next after fuch Seizure, fuch Goods, Wares, Merchandizes and. Commodities fo feized, fhall from Time to Time, be put into, and be placed, lodged and fecured in Manner herein after Where fuch mentioned, that is to fay, If fuch Goods, Wares, Merchandizes and Commodities are prohibited or lia- f.'izedGoods ble unto, or chargeable with only Duties of Cuftoms, or Import Duties, and are not liable unto, or fliail be lodged, chargeable with any Excife or Inland Duty or Duties, that then the fame be put into, and be placed, lodged and fecured in fome Warehoufe or Warehoufes belonging to his Majefty, under the Care and Ma- nagement of fome of the Officers of his Cuftom or Import Duties, near to the Place where the fame fhall belfeized ; and in cafe fuch Seizure be made at a Place too remote from any fuch Warehoufe, the fame fhall be lodged in fome Excife- Office near to the Place of fuch Seizure; but if fuch Goods, Wares, Mer- chandizes or other Commodities be liable to any Excife or Inland Duty or Duties, that then and in fuch Cafe, the fame within the refpective Times aforefaid, be put into, and be placed, lodged and fecured in fome
