XIX. And be it further enacted by the Authority aforefaid, That every Pcrfon and Perfons whatl -oSaie fo offering or expofmg to Sale fuch Goods, Wares, Merchandizes and Commodities as afof faid, ■: ' ■ and befides the forfeiting fuch Goods, Wares, Merchandizes and other Commodities, fhall alio forfeit and lofe the treble Value thereof, to be eftimatcd in Manner as aforefaid. »nd treble V«Jce. And be it further enacted by the Authority aforefaid, That all and every the like prohibited or Prohibit* run Goods, Wares and Merchandizes whatfoevcr, fo or as fuch bought by any Pcrfon < . i I - ■ foever, together with the Package containing the fame, fhall in like Manner be forfeited, ;:nd ihall and flom l,lt & " may be feized, and taken from fuch Buyer or Buyers thereof, cither by the Seller or Sillers thereof or by any Officer or Officers of Cuftoms or Excife; provided that within the like refpeftive Times, as are herein before limited and appointed of and concerning Goods, Wares, Merchandizes and Commodities to be feized from the Perfon or Perfons expofing or offering thereof to Sale, fuch Goods, Wares, Merchan- dizes and Commodities fo to be feized from fuch Buyer or Buyers thereof, be placed, lodged and fccuicd in the like Places refpectively, and in the like Manner, and in the Cuftody of the like Perfons refpectively, as is before directed and appointed, of and concerning Goods, Wares, Merchandizes and Commodities, feized or to be feized from the Perfon or Perfons offering or expofing thereof to Sale. XXI. Wares, Merchandizes or Commodities as aforefaid, but that the Party or Parties, whether Buyer or Seller of, or offering or expofing to Sale fuch Goods, Wares, Merchandizes or Commodities, who with Effect fhall firft profecute the other of the faid Parties for fuch the treble Value of fuch Goods, Wares, Merchandizes or Commodities, fhall in every fuch Cafe and Cafes, be and is hereby declared difcharged and acquitted of and from the like forfeiting, or being profecuted for or on Account of the treble Value of every fuch refpettive Parcel and Parcels of Goods, Wares and Merchandizes, or Commodities, for and on Account whereof the other Party or Parties, fhall be profecuted with Effect ; Provided always, that if within one Month next after making fuch Seizure as If Profecution be aforefaid, either by the Seller or Buyer, or by the Party or Parties, to whom fuch Goods, Wares, Mer- not "mmenccd , chandizes or Commodities are or fhall be offered or expofed to Sale, a Profecution or Profecutions is not Month ™ commenced, and afterwards carried on for the adjudging and determining of and concerning the forfeit- houfe-kecper ing or not forfeiting of fuch Goods, Wares, Merchandizes or Commodities, by the Party or Parties as may profecute. fliall fo feize the fame, That then and in every fuch Cafe and Cafes, the Warehoufe-keeper or Keeper of the Office of Excife or Inland Duties, or other, Perfon or Perfons in whofe Cuftody fuch Goods, Wares, Merchandizes and other Commodities fhall be lodged and fecured, fliall and may profecute for the For- feiture of fuch Goods, Wares, Merchandizes and Commodities, as after having been fo lodged and fe- cured as aforefaid, fhall not within fuch Month next after fuch Seizure be profecuted for by the Party or Parties who fhall have feized the fame. ' XXII. And whereas before and at the Time of the Commencement of the Inland Duties upon
- Chocolate, granted by an Act made in the tenth Year of his prefent Majefty's Reign, intituled, An Aft ioGeo. i.e. 10;
- for repealing certain Duties therein mentioned, payable upon Coffee, Tea, Cocoa-Nuts, Chocolate and Cocoa-
' Pajle imported, and for granting certain Inland Duties in Lieu thereof, and for prohibiting the Importation of
- Chocolate ready made, and Cocoa-Pafte, and for better afcertaining the Duties payable upon Coffee, Tea and Co-
' coa-Nuts imported, there were in his Mjefty's Warehoufes, under the Care and Cuftody of his Officers ' of Cuftoms, feveral Quantities of Cocoa-Pafte, and of Chocolate imported ready made, which had
- been feized for having been imported and landed without making due Entries and paying the Duties
' thereof: And whereas feveral other Quantities of Cocoa-Pafte and Chocolate imported and landed and ' feized, fince the Commencement of the aforefaid Act, and contrary thereto, already are and hereafter
- may be in fuch or the like Warehoufes : And whereas one Moiety of the appraifed Value of fuch Co-
' coca-Pafte and imported Chocolate, when condemned in his Majefty's Courts of Exchequer, either at ' JVeflminfter or in Scotland . or of the Rate and Price for which the fame hath been or fliall be bought at ' in his faid Majefty's faid Courts refpectively, doth and will belong to his Majefty, his Heirs and Suc- ' ceffors, and the other Moiety to the Party or Parties who feized or hath bought the fame as aforefaid ; ' but neither of the faid Moieties can be raifed, unlefs the fame be fold and difpofed of, which cannot be ' done without being liable to be feized a fecond Time, unlefs the fame be inclofed in Paper, ftamped or
- marked with the Stamp or Mark already provided, in purfuance of the aforefaid Act :' For Remedy-
whereof, Be it enacted and declared by the Authority aforefaid, That as for and concerning fuch Choco- Chocolate, &e. . late or Cocoa-Pafte, as in the Manner before mentioned actually and really was in fuch Warehoufe or Warehoufed be- Warehoufes before the faid twenty-fourth Day of June one thoufand feven hundred and twenty-four, in { ° r ^^H fot Cafe the refpective Seizors or Buyers thereof do or fliall refpectively, on or before the twenty-fourth Day 24 July"^^ 6 of'July now next enfuing, enter the fame with the refpective Receiver or Collector of the Inland Duties entred with the of the Place and Places, where fuch refpective Warehoufe or Warehoufes ihall happen to be, and fhall inland Collector.- Vex..
