I. -cs8. or'poflefTed of, interefted in, or entitled unto, in Law or Equity in their or any of their own Rights, or to his or their own Ule or Ufes, or in Partnerfhip with any others (except as in the faid Adt is excepted) were, by Force and Virtue of the faid Act, vefted and fettled in Sir John Eyles, Baronet, Sir Thomas Crofs, Baronet, John Rudge, Efquire, Matthew Lant, Efquire, Roger Hudfon, Efquire, now Sir Roger Hudfon, Knight, Edmund Ha/fey, Efquire, John Lade, Efquire, Gabriel Roberts, Efquire, and Richard Hopkins, Efquire, now Sir Richard Hopkins, Knight, thereby nominated and appointed Truftees for the Ufes and Purpofes in the faid Adt exprefled of and concerning the fame, and the Heirs, Executors, Adminiftrators and Affigns of the fame Truftees, from the refpedtive Times in the faid Adt mentioned, to the Intent the fame might be fold and difpofed of, or otherwife applied to and for the Ufes and Purpofes in the faid Act exprefled concerning the fame, and that the clear Monies arifmg thereby fhould be appropriated to and for the Ufe of the South-Sea Company, in fuch Manner as therein is exprefled (except as in the faid recited Act is excepted) fubjedt to the paying and fatisfying fuch Claims as fhould be duly made and allowed in Purfuance of the faid Act, and alfo to the Payment of the feveral Allowances made by the faid Act, to the faid late Sub-Governor, Deputy-Governor, Directors, Cafhier, Deputy-Cafhier and Accountant of the faid South-Sea Company, in and by which faid Adt, as alfo by feveral fubfequent Adts of Parliament, rela- ting to the faid Eftates vefted in the faid Truftees, divers Directions, Powers and Authorities are given to the faid Truftees for the due Execution of the faid Truft ; in Purfuance of which faid recited Adt, and alfo of feveral fubfequent Adts of Parliament, made for enlarging the Times limited for entering, hearing and determining Claims on the faid Eftates, divers Claims were entered before the faid Truftees, and all fuch Claims and all Queftions and Differences which arofe thereupon, are now finally ended and determi- ned, in Purfuance of the firft mentioned Adt ; but fome few of the faid Claims yet remain to be fatisfied, the Claimants or their Reprefentatives not calling for the Allowances thereupon made : And 'whereas the feveral Purpofes, for which the Eftates of the faid John Aijlabie and James Craggs, deceafed, were fo as aforefaid vefted in the faid Truftees, have been obtained and fatisfied, by Means whereof, and of feve- ral Provtfions in the faid recited Adt, their feveral and refpedtive Eftates, fo vefted as aforefaid, have been revefted in the faid John Aijlabie, and in the Heirs, Executors or Adminiftrators of the faid James Craggs, refpedtively ; and as to the reft of the faid Eftates and Effedts, very great Parts or Parcels of them have been fold or difpofed of, but there are fome few of the Lands and Hereditaments, and other Effedts and Interefts which remain yet unfold, and feveral of the Eftates which have been fold, are not yet fully paid for or conveyed ; and there are feveral Parts of the faid perfonal Eftates and Sums of Money vefted in the faid Truftees, which yet remain to be got in and difpofed of ; and fome Suits in Law or Equity relating to the faid Trufts, are now depending : And whereas the faid Truftees have made feveral Reports to his faid late Majefty, and his prefent Majefty, and both Houfes of Parliament, in Purfuance of the faid fTrft men- tioned Act, and in their laft Report, bearing Date on or about the one and twentieth Day of January Anno Domini one thoufand feven hundred and twenty-eight, taking Notice that they had aimed executed the Truft repofed in them as aforefaid, did humbly fubmit, whether the faid Truft fhould continue in them for compleating what remained undone therein : And whereas, upon due Confideration of the faid Report, it is judged that the feveral Matters and Things remaining unperformed or unexecuted, may re- quire a confiderable Time intirely to compleat and execute the fame, and may for the future be as well per- formed and executed by the faid South-Sea Company, for whofe Benefit the faid Truftees were firft ap-
- pointed, as by the faid Truftees, and the further Continuance of the faid Truftees, and their Officers,
' would be an unneceflary Charge on the faid Company :' May it therefore pleafe your moil Excellent Ma- jefty, that it may be enacted, &c. EXP. " All the Eftates of the late Diredtors vefted in Truftees on 24 December 1729, and unfold, vefted in the " South-Sea Company, &c. Truftees to deliver over to the Company all Things touching thofe Eftates. " Accountants to the Truftees to refund to the Company's Cafhier all Monies not expended. Company " to indemnify the Truftees. All the clear Money arifen from the Eftates of the late Directors to be ap- " plied according to the Direction of 13 Geo. 1. c. 22. The faid Eftates not to be deemed as Part of the " Lands the Company by Charter are capable to purchafe." CAP. IX. An Aft to repeal a Claufe in an Aft made in the ninth Year of his late Majtfty's Reign, which prohibits the Importation of Tobacco llript from the Stalk or Stem. r H E R E A S by an Act made in the ninth Year of the Reign of his late Majefty King George the Firft, for enabling his Majefty to put the Cuftoms of Great Britain under the Management of one or more Commijjioncrs, and for better fecuring and ajcertaining the Duties on Tobacco, and to prevent Frauds in exporting Tobacco, and other Goods and Merchandizes, or carrying the fame coofiivife, it was (amongft other Things) en- acted, That from arid after the firft Day of June in the Year of our Lord one thoufand feven hundred and twenty-four, no Tobacco fhould be imported into Great Britain, ftript from the Stalk or Stem ; and in cafe any Tobacco ftript from the Stalk or Stem fhould be fo imported, after the faid firft Day of June, the fame fnould be feized, and fhould be liable to be fearched for, and forfeited, by any Officer of the Cuftoms, ' in the fame Manner as any other prohibited Goods might by Law be fearched for or feized ; which Claufe ' hath been found very prejudicial to the Planters of Tobacco in America, and to the Tobacco Trade of this '^kufein an Aft ' Kingdom : May it therefore pleafe your Majefty that it may be enacted,' And be it enacted by the King's 9 Geo. i.e. si. m0 {t Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and btccoXiptfVom Commons, in this prefent Parliament aflembled, and by the Authority of the fame, That the faid Claufe in the jGeo.
