That if any Perfon or Perfons fliall keep ing an Office, org^y Office, or print or publifti any Scheme or Propofal for receiving any Sum or Sums of Money, in con- pubhftmgany f,(^eration of an Intetcft to be granted for the fame in any Ticket or Number of Tickets in the faid Lot- ciemc, c. teiy, or in conlideration of any Sum or Sums to be repaid in cafe any Ticket or Number of Tickets in the faid Lottery fhall prove Fortunate, all and every fuch Perfon and Perfons fhall forfeit and pay the Sum of five hundred Pounds, to be recovered by Action of Debt, Bill, Plaint or Information in any of his Ma- jefty's Courts of Record at IVeJinunfler^ in which no Efibin, Proteftion or Wager of Law, or more than one Imparlance fhall be allowed ; one Moiety whereof to be for the Ufe of his Majefty, his Heirs or Suc- cefTors, and the other Moiety to he paid to the Perfon or Perfons who fhall fue for the fame, and alfo fliall fuffer three Months Imprifonment without Bail or Mainprize, ' XLII. And whereas many and great Inconveniencies have arifen upon the Occafion of former Lot- ' teries by the exceflive Advance of the Price of Tickets, efpecially during the Time of drawing fuch Penalty on I'er- ' Lotteries ;' For Remedy thereof be it further enabled by the Authority aforefaid. Ticket in the faid Lottery, or any Receipt for Tickets to be made out in purfuance of this Aft; and every Perfon who fhall fo fell, alienate or deliver any Ticket or Receipt for Tickets, fhall forfeit and lofe the Sum of ten Pounds for every Ticket which fhall be fo fold, alienated or delivered, and for every Ticket which fhall be contained in any Receipt for Tickets fo fold, alienated or delivered; and fhall upon Con- vi£tion be committed to the County Gaol, there to remain without Bail or Mainprize for the Space of one Calendar Month, and until the Sums fo forfeited as aforefaid fhall be fully paid and fatisfied ; and every Per- fon fo buying or receiving fuch Ticket or Receipt for Tickets fhall forfeit and lofe the fame, and fhall not be infilled to receive any Benefit from the drawing fuch Tickets ; all which Penalties fhall and may be recovered by Acffion or Information in any of his Majefty's Courts of Record at JVejhnhiJhr, or before any two of his Majefty's Juftices of the Peace of the County, City, Divifion or Liberty where fuch Offence fhall be com- mitted, or the Ofi'ender fhall be found, upon the Oath or Oaths of one or more credible Witm-fs or AVit- AppLcat.on of nefles (which Oaths fuch Juftices are hereby impowered and required to adminiftcr) ; all fuch Penalties to be applied, one third Part to the Ufe of hisMajelfy, his Heirs and SuccefTors, one other third Part thereof to the Informer, and the remaining third Part thereof to the Poor of the Parifh where fuch OfTence fhall be Perfons aggrieved committed; and in cafe any Perfon fliall find himfelf aggrieved by any Determination of the Juftices, it nny appeal 10 the fhall be lawful for fuch Perfon to appeal to the Quarter-Seftions for the faid County, City, Divifion or Li- Quarter-Seihons. beitv, whofe Determination fliall be final.
