G. 6. 577 ' Provifioii which ordinarily the Clergy within the faid Archdeaconry are able to make for the Support of ' their Families, and tends greatly to the impoveriihing the fame : And whereas the Bilhops oi Chejier as ' Archdeacons oi Chcfter forthe Time being, are feifed of the Advowfon, Right of Patronage, and Pre- ' fentation of, in and to the Redtory of the Parith Church of IVaverton alias IVareton, in the'la'id Diorefe ' and Archdeaconry of Chejier, and the Right Reverend Edtnund now Lord Bifhop of CheJ},;r, at the In- ' fence and Requeft, and upon the Propofal of the greateft Part of the Clergy within the faid Archdea- ' conry, hath confented that all the Mortuaries or Corfeprefents due and payable upon the Death of Cler- ' gymen within the faid Archdeaconry, fliall for the future ceafe and be abolilhed, fo as that in lieu thereof ' and as a Compenfation for the fame, the faid Redlory or Parfonage of IVaverton alias JVarcton with the ' Appurtenances thereof, (hall be annexed to the faid Archdeaconry of Chefter, and held and enjoyed by ^ the faid Bifhop as Archdeacon o^ Chejier, and his Succefibrs for ever, fubjeii: neverthelefs to fuch Stipend ' and Provifion for a Minifter or Curate of the faid Parifh and Parifti Church of IVaverton alias IVareton ' and his SuccelTors, as is herein after mentioned; and as the carrying fuch Propofal and Requeft into ' Execution and Effeft would contribute greatly to the Satisfaflion, Encouragement, and Benefit of the "
- Clergy within the faid Archdeaconry :' Therefore for the anfvvering, obtaining, and accomplifliing the
good Ends and Purpofes afore-mentioned ; Be it enafted by the King's moft Excellent Majefiy by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parlia- ment affembled, and by the Authority of the fame. '=<'"'■)' °f Chefter Corfeprefent, or any Goods, Chattels, EfFefts or Things, for or in the Name of a Mortuary or Corfe- '°"'^ prefent, upon the Death of any Clergyman within the iaid Archdeaconry of CheJler, fhall, from and after fuch firft Vacancy or Avoidance of the faid Church or Living of IVaverton alias IVareton, be utterly void and totally abolifhed for ever ; and no Mortuary or Corfeprefent, or Sum or Sums of Money for or in lieu and no Compen- of, or in the Name thereof, or in Commutation for the fame, fhall be yielded, paid, anfwered or fatisfied Nation to be paid or be due or payable by or from any Perfon or Perfons to any Bifhop of the faid Diocefe of CheJier either ""^ demanded in as Diocefan or Archdeacon of CheJler for the Time being, or to any Perfon or Perfons authorized by or '"^" ^'^'^°^* claiming under him, them, or any of them ; and that from and after fuch Vacancy or Avoidance as afore- faid, it fhall not be lawful to and for the Archdeacon of CheJler or his SuccelTors, Farmers, Bailiffs or Lellees, or any of them, or any Perfon or Perfons whatfoever claiming by or under fuch Archdeacon or his SuccelTors, to take, receive or demand, of any Perfon or Perfons whatfoever, any manner of Mortuary or Corfeprefent, or any Sum or Sums of Money, or other Thing for or in lieu or Name of, or in Commuta- tion for any Mortuary or Corfeprefent, or to convene, cite, fue or profecute any Perfon or Perfons be- fore any Judge Spiritual, or in any of his Majefty's Courts of Law, or other Court whatfoever for the Recovery of, or i^or, touching or concerning any Mortuary or Corfeprefent, or any Thing in lieu' thereof for or by reafon or on account of the Death of any Prieft or Clergyman within the faid Archdeaconry of CheJler, at any Time after fuch Vacancy or Avoidance as aforefaid ; any Thing in the faid recited A61: or any Law, Cuftom or Ufage whatfoever to the contrary notwithftanding. III. IV. And it is hereby further enaded.
