The Monies contributed to be a Joint Stock, &c. time, without Delay, apply and pay the fame accordingly, and render his Account thereof according to the due Courle of the Exchequer; any thina; herein contained to the contrary notwithftanding. XLII. And it is hereby alfo en.icled. That the faid Accomptant General for the time being, fliall, from time to time, infpedt and cxamin: all Receipts and Payments of the faid CatTiier or CafSiers, and the Vouchers relating thereunto, in order to prevent any Fraud, Negligence, or Delay; and that all and every Perfon and Perlbns whatfoever, who {hall be intitlcd to any of the fajd feveral and refpeiTtive Annuities, af- ter the Rate of four Pounds ^tf;- Centum per Annum^ and all Perlbns lawfully claiming under them, fhall be poflefled thereof as of a Perfonal Eftate, and the fame {hall not be defcendible to the Heir, and fhall not be liable to any Foreign Attachment by the Cuftom of London^ or otherwife ; any Law, Statute or Cuftom to the contrary notwithftanding. XLIII. And be it further ena£ted by the Authority aforefaid. That all Monies to be advanced or contri- buted, or to which any Perfon or Perfons fhall become entitled upon this Ad, for or towards the faid Sum not exceeding one million, {hall be deemed, reputed, and taken to be one Capital or Joint Stock, on which the faid feveral and refpeftive Annuities, after the Rate of four Pounds per Centum per Annum, fhall be at- tending ; and that all and every Perfon and Perfons, and Corporations whatfoever, in Proportion to the Money by him, her or them advanced, or to which they fhall become intitled as aforefaid, upon this Aft, fhall have, and be deemed to have a proportional Intereft and Share in the faid Stock, and in the Annuity attending the fame, at the Rate aforefaid ; and that the faid whole Capital or Joint Stock, or any Share or Interefl: therein, and the proportional Annuity attending the fame, fhall be aflignable and transferrahle as this Aft direfts, and not otherwife ; and that there fhall conftantly be kept at all feafonable Tnnes, in the &.°r,!°!(>«° Office of the faid Accomptant General for the time being, within the City of London, a Book or Books,, wherein all AfTignments or Transfers of the faid whole Capital or Joint Stock, or any Part thereof, and the proportional Annui'ty attending the fame, at the Rate aforefaid, fhall be entered and regiftered ; which En- tries {hall be conceived in proper Words for that Purpofe, and fhall be figned by the Parties making fuch Ailignments or Transfers ; or if fuch Parties be abfent, by his, her or their Attorney or Attornies thereunto lawfully authorized, by Writing under his, her or their Hands and Seals, to be attefted by two or more cre- dible WitnelTes ; and that the Perfon or Perfons, to whom fuch Transfer fliall be made, do underwrite his, her or their Acceptance thereof; and that no Method of affigning or transferring the faid Stock, and the Annuities attending the fame, or any Part thereof, or any Interefl therein, fliall be good or available in Law. XLIV. Provided always, That any Perfon or Perfons poffelTed of fuch Stock, with the Annuity or An- nuities attending the fame, or any Eftate or Intereft therein, may devife the fame by Will, in Writing, at- tefted by two or more credible WitnelTes ; but that fuch Devifee fhall receive no Payment thereupon, till fo much of the faid Will, as relates to the faid Stock or Annuity, be entred in the faid Office ; and in De- fault of fuch Transfer or Devife, the faid Stock and Annuities attending the fame, fhall go to the Executors or Adminiftrators ; and that no Stamp Duties whatfoever fliall be charged on the faid Transfers, or any of them ; any other Lawr or Statute to the contrary notwithftanding. XLV. Provided always, and it is hereby enadled by the Authority aforefaid. That the faid Governor and continue a Conn- Company of the Bank of England, and their SuccefTors, (notwithftanding the Redemption of all or any deraption f'the t^^'*" W Funds, in purfaance of the Acts for eftablifhing the fame, or any of them) Ihall continue a Cor- poration, with all the Powers, Privileges and Advantages thereunto belonging, for the Purpofes in this hSi. exprelTed, till all the Annuities to be purchafed on this A<51 fhall be redeemed by Parliament, according ta the Provifo herein after contained in that Behalf; and the faid Governor and Company, or any Members thereof, fhall not^ncur any Difability for or by Reafon of their doing any Matter or Thing in purfuancc of this Aa. XL VI. And it is hereby enacted by the Authority aforefaid. That no Fee or Gratuity whatfoever, fhall be demanded or taken of any of his Majefty's Subjedfs, for receiving or paying the faid Contribution-monies, or any of them, or for any Tallies or Receipts concerning the fame, or for iiTuing the Monies for paying the. faid feveral Annuities, or any of them ; and that no Fee or Gratuity fhall be demanded or taken for any Transfer of any Sum, great or fmall, to be made in purfuance of this Adl ; upon Pain that any Officer or Perfon offending, by taking or demanding any Fee or Gratuity contrary to this Acft, fhal! forfeit the Sum of twenty Pounds to the Party grieved, to' be recovered with full Colls of Suit, in any of his Majefty's Courts of Record at Weftminjhr. XLVII. Provided always, and be it enaiSted by the Authority aforefaid, That the Commiffioners of the Treafury, or any three or more of them now being, or the High Treafurcr, or any three or more of the A "v' out of the Commiffioners of the Treafury for the time being, {hall have Power, and they are hereby authorized out of Duties, the faid feveral Rates and Duties by this Adl granted and appropriated as aforefaid, to difcharge all fuch inci- dent Charges, as fhall necelTarily attend the Execution of this A(Sl, in fuch Manner, as to them fhall feem juft and reafonable ; and alfo to fettle and appoint fuch Allowances, out of the Contributions aforefaid, as they fhall think juft and reafonable, for the Service, Pains and Labour of the Receiver or Receivers of the Contributions to the faid Lottery, for receiving and accounting for the fame ; and alfo fuch further Allow- ances, out of the faid feveral Rates and Duties by this Act appropriated, as they fliall think juft and rea- fonable, for the Service, Pains and Labour of the Cafhier or Cafniers of the Governor and Company of the Bank of England, for receiving, paying and accounting for the feveral and rcfpeJlive Annuities, payable in refpedl thereof; and alfo for the Service, Pains and Labour of the Accomptant General of the faid Go- vernor and Company, for performing the Duty and Truft incumbent on him by ^his Aft ; all which Al- lowances hereby impowered to be made as aforefaid, in refpeiSt ta the Service, Pains and Labour of any Of- ficer or Officers of the faid Governor and Company, fliall be for the Ufe and Benefit of the faid Governor an.d Company, and at their Difpofal only ; any thing herein contained to the contrary notwithftanding. 4.
