C A P. X. An Aft for the better afcertaining, recovering and colledling certain Duties payable upon the Importation and Exportation of Goods and Merchandizes into or out of the Har- bour of the Town and County of Poole ; and alfo of Ballaft and Boomage Duties, pay- able in refpeft of Ships and Veflels coming into and going out of the faid Harbour ; and for the enlarging, better repairing and keeping in Repair the faid Harbour, and the Quays and Wharfs ; and for providing a proper place for keeping Gunpowder in or near the faid Town ; and for eftablifhing and regulating a nightly Watch, and enlightening the Streets in the faid Town., P R. ' H E R E A S the Mayor, BailifTs, Burgefles and Commonalty of the Town and County of the Town of Pook have. Time out of Mind, received and been intitled to receive certain Duties called Petty Cuftoms or Wharfage, upon the Importation and Exportation of all Goods and Merchan- dizes into and out of the Harbour of Poole aforefaid, from the Owner, Importer or Exporter of fuch Goods and Merchandizes, and alfo certain other Duties called Boomage and Ballaft Dut^', from the Mafters or Commanders of Ships and Veflels ; which faid feveral Duties have been conftantly under ' the Management of the Mayor, BailifTs and BurgefTes of the faid Town and County of the Town ot Pook, as Truftees and ianagers ; and the faid Duties have been applied for the repairing the faid Harbour, Quays and Wharts, and other Works neceflary for the more convenient Ufe of the fame, within the faid Town and County : And whereas feveral Perfons have refufed to pay the laid ' Duties, induced thereto by the great Difficulties in fupporting, by ftrid legal Evidence, prefcriptive Claims and Rights to Duties on each particular Species or Goods, and the exadl and precife Sums pay- able for the fame : And although the faid R'layor, Bailiffs, Burgefles and Commonalty have brought feveral Aelions, in order to eftablifli fuch their ancient Rights ; yet, by Means of the Expences in carrying on fuch Suits, and the many continued Evafions and Refufals of Payment, the Money raifed by fuch Duties is not fufficient to repair the faid Harbour, Quays and Wharfs, which are now in a ruinous Condition, and will be intirelv deftroyed, if not timely prevented :' For Remedy whereof, be it tnaded, is'c. There (hall be paid to the Mayor, trV. the Rates and Duties mentioned in the Schedule, and no others.
