An Aft for granting a Duty to his Majefty, to be paid by DifliilerSj upon Licences taken out by them for retailing Spirituous Liquors, ' TT/HEREASbyan AA of Parliament made and paffed in the fixteenth Year of the Reign of his pre- ,6 Geo. a, c. 8, t yy fent Majefty intituled, An A£i for repealing certain Duties on Spirituous Liquors, and on Licences for ' retailinc the fame ; and for laying other Duties on Spirituous Liquors, and on Licences to retail the /aid Liquors ;
- it was, amongft other Things, enafted. That no Perfon or Perfons fhould, from and after the twenty-
- fifth Day of March one thoufand feven hundred and forty-three, prefume to retail any Brandy, Rum Ar-
- rack, Ufquebaugh, Geneva, Aqua Vita, or any other diftilled_ Spirituous Liquors or Strong Waters
- unmixed, or mixed with themfelves, or any other Ingredients, without firft taking out a Licence from
- his Majefty 's Commiffioners of Excile for fo doing, in Manner as was therein diredted and appointed, and
- upon Payment of the Sum of twenty Shillings yearly for fuch Licence, under the Penalties in the faiJ
- Aft contained ; and no Licences were thereby allowed to be granted for retailing, except to fuch Perfons
- only who fliould keep Taverns, Viftualling-houfes, Inns, Coffee-houfes or Ale-houfes ; and it was therein
- alfo enadted. That no Perfon Ihould be deemed or taken to be a Retailer of Spirituous Liquors, who did
- not retail in lefs Quantities than one Pint : And whereas by another Aifl of Parliament made and pafled
- in the -feven teen th Year of his Majefty's Reign, intituled. An ASi for granting to his Majefty the Surplus irGeo.i.c, 17,
- or Remainder of the Monies arijen, or to arife, by the Duties on Spirituous Liquors, granted by an A£i of the
- lafl Seffion of Parliament ; and for explaining and amending the /aid AH, in relation to the Retailers of fuch
- Liquors ; and for eflablijhiyig an Agreement with the United Company of Merchants of England trading to the
- Eaft Indies ; it was, amongft other Things, enaded. That from and after the twenty-fourth Day of
' June one thoufand feven hundred and forty- four, every Perfon who Ihould retail any Spirituous Liquors,
- mixed or unmixed with any Ingredients, in lefs,Quantity than two Gallons (except fuch Perfons, only as by
' the faid Aft of the fixteenth Year of his prefentMajefty, were authorized and impowered to take out Licences ' for that Purpofe) fhould be deemed a Retailer of Spirituous Liquors_ within the Meaning of the fame, and
- as fuch, forfeit and lofe the Sum of ten Pounds for every fuch Offence: And v/hereas the Reftriftions
- and Penalties in the faid Afts contained, have been found to be inconvenient, fo far as relates to honeft
.* reputable Diftillers, and the Alteration thereof, in that Particular, will alfo tend to the Benefit of his Ma-
- jefty's Revenue:' We your Majefty's moft dutiful and loyal Subjefts, the Commons of Great Britain m
Parliament affembled, do give and grant unto your Majefty the Rates and Duties on certain Perfons to be hereby authorized to retail Spirituous Liquors herein after mentioned ; and do moft humbly befeech your Majefty, that it may be enafted; and be it therefore enafted by the King's moft Excelfent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Par- liament affembled, and by the Authority of the fame. That from and after the twenty-fourth Day oijnne Diflillers withia in the Year of our Lord one thoufand ieven hundred and forty-feven, it fliall and may be lawful to and for the Bills of the feveral Diftillers within the Cities of London and IVeJhninJler, Borough of Southvjark, or Weekly Bills Mortality may of Mortality, to take out Licences from his Majefty's Commiffioners of Excife, for retailing Brandy, Rum, '^'^'^ "^^ ■" Arrack, Ufquebaugh, Geneva, Aqua Vita, or any other Spirituous Liquors or Strong Waters ; and the ""^*' faid Commiffioners of Excife are hereby authorized, impowered and required to grant fuch Licences to uponPajinent every Diftiller and Diftillers, within the Limits aforefaid, who fliall apply for the fame, upon Payment of of 5I. yearly. five Pounds for every fuch Licence, to be raifed, levied, collefted and paid to his Majefty, his Heirs and ' This Duty re- Succeffors ; and the fame to be renewed yearly, upon Payment of the like Sum of five Pounds, and to the P^^led by 14 fame Ufes, Intents and Purpofes, and I'uch Licences to be taken out in the fame Manner, and fubjeft to the ?!°' -• '^' ^°-' like Penalties for retailing without Licence, as are direfted, appointed, and enafted by the above-mentioned '^' AA of the fixteenth Year of his prefent Majefty. II. Provided always. That no more than one Licence fliall be granted to any Diftiller or Diftillers in DirtiiiersinP.irt- Partnerftiip, whereby to authorize him, her or them to retail any Spirituous Liquors, or Strong Waters, ""ftip to have within the Intent and Meaning of this Aft ; and that no fuch Diftiller or Diftillers fnall be allowed to take '""°"« Ucencc, out a Licence by the Authority of the fame, unlefs he, flie or they, inhabiting within the City of London, Qi!^'<:'"'on t'^r are refpeftively rated, and do pay Church and Poors Rates for the Value of tv/enty Pounds per Annum, "^"'"■' and inhabiting in any other Parts within the Weekly Bills of Mortality, for the Value of ten Pounds per Annum, in the Parifli or Place where he, fhe or they ftiall exerciie the Trade of Diftilling ; and if any Li- cences fhall be granted otherv/ife, or to any other Perfons than as aforefaid, the fame are hereby declared void to all Intents and Purpofes. III. And be it further enafted by the Authority aforefaid.
