He was b. 16 Nov. 17S4 and was sometime (1804) an officer in the 5th Dragoon Guards. He m. 28 May 1S04(") Johanna, da. of Charles Gordon, of Chinie, but (not considering such marriage to be valid) m, 3 June 1808 at St. Geo. Han. Sq. (spec, lie.) Laura, yst. da. of John Manners, by Louisa, afterwards tUO jurt Countess of Dysart [S.J. This last marriage was, however, set aside in consequence of a decision in the Eceles. court [E.] lb' July 1811, that the previous one was good.( b ) The marriage of 1804. however, was itself annulled six years later in June 1820 the said Johanna being divorced for adultery. ( c ) The Earl who '• for the last eleven years had been confined to his bed. speechless and almost unconscious, "() d. at his hotel iu the Rue de Clichy, Paris, 20 March 1840, aged 55. Will pr. Edinburgh, which John (who d. 26 Feb. 1810 aged 84) was s. and h. of Sir William D.u.hymple.C) 3d (") Riddell (p. 38S) states that the marriage was held lawful " merely iu virtue st private writings and correspondence containing simple promises and acknowledgment! of marriage, not formally authenticated or attested by others," and pp. 390—555) discusses the whole subject of Scotch " Cunsistorial Law." ( b ) The Lady thus set aside, who, after her mother's succession to the peerage abovestated 9 March 1821, became Lady Laura Tollemache, never agaiu essayed matrimony, and d. 11 July 1834, aged .14 at Ham House, in l'etersham. O The following table illustrates the remarkable succession of these Earls. It is given iu "jr. and Q.," 8th S. vii, 302, as illustrating " the extraordinary fatality attendant on the descendants of the first Earl, unhappily notorious for his connection with the massacre of Gleneoe," shewing " that the 2d, 3d, 4th. 6th, 7th and 8th Earls all died without issue," and how, on the death of the last-named Earl in 1810, the issue male of the first Earl became extinct, and the succession passed over to the descendants of his brother.
