LORD BALMERINOCH [S.], and took his place in Pari, accordingly. He was however found guilty of the fabrication of a letter (in 1599) purporting to be from James VI to Pope Clement VIII, and was on 10 Mar. 1608/9 sentenced to death and attainted. (") He m., istly, 21 Mar. 1588, Sarah, da. of Sir John Menteth, of Carse. She was living 14 Dec. 1592. He »»., 2ndly, before 23 Dec. 1597, Marjory, da. of Hugh Maxwell, of Tealing. C") She was living 12 Aug. 1601. He d., 21 June 1612, at Balmerinoch, " of a weakness in the stomach, " while under attainder.() II. 1 613. 2. John (Elphinstone), Lord Balmerinoch [S.], s. and h. by ist wife, was restored in blood, and to the peer- age, by Royal letters 4 Aug. 1613. He was a leading Covenanter, taking a most active part against the King, being one of those who implored the assistance of Louis XIII of France against him. His trial and conviction (by a majority of one) 3 Dec. 1634 to 20 Mar. 1634/5, for joining in a petition to the Crown against grievances, greatly exasperated the feelings of the Scots towards the Monarchy. He was President of the Pari. [S.] 1 64 1, Extraord. Lord of Session 1641-49, and was one of those who were against rescuing the King from his imprisonment in 1648. He sat in the Pari. 4 Jan. 1648/9, where those who were concerned in the " Engagement " were proscribed. He m., shortly after 30 Aug. 1613, Ann, sister of Robert, Earl of Somerset, da. of Sir Thomas Ker, of Fernihirst, co. Jedburgh, by his 2nd wife, Janet, da. of William Scott, of Buccleuch. He d. suddenly, 28 Feb. 1648/9, of apoplexy, at Edinburgh, and was bur. In the Logan cemetery at Restalrig. (**) His widow d. at Leith, 15 Feb. 1649/50, and was bur. with him. III. 1649. 3. John (Elphinstone), Lord Balmerinoch [S.], s. and h., ^. 18 Feb. 1623, at Edinburgh. By reason of the heavy debts of his father and of several law suits, he was forced to sell nearly all his estate. In 1662 he was fined by Pari. £6000 (Scots) for his compliance with Cromwell's Government. By the death of his uncle James (Elphinstone), Lord Coupar [S.], in 1669, he sue. (under the spec. rem. of that Peerage, 20 Dec. 1607) to the title of LORD COUPAR [S.] and to the estate of Coupar in Angus. Hew., 30 Oct. 1649, in the chapel of Holyrood House, Edinburgh, Margaret, 2nd and yst. da. of John (Camp- bell), 1st Earl of Loudoun [S.], by Margaret, suo jure Baroness Loudoun [S.]. She d.
