then (1745) Earl. Restored 16 May 1826. In the act of 19 Geo. II., there were also included ; Alexander (Erskine) Earl of Kellie, who having surrendered before 12 July 1746 (before the attainder took effect), was par- doned. "James Drummond, Esq., " ist s. and h. ap. of William, Viscount OF Strathallan. " Simon Eraser, Esq., " ist s. and h. ap. of Simon, Lord Lovat. "James Drummond, taking upon himself the title of Duke of Perth " [i.e. James then styled Lord Drummond, attainted by act I Geo. I., s. and h. ap. of the Earl of Perth, to whose digni- ties he was accordingly barred from succeeding]. " James Graham, late of Duntroon, taking upon himself the title of Viscount of Dundee " [i.e., the collateral heir male of that Viscountcy, cr. 1688 forfeited 1690]. " John Nairn taking upon himself the title or style of Lord Nairn" [i.e., John, s. and h. of William, Lord Nairne, who was attainted by act, I Geo. I.]. " David Ogilvie taking upon himself the title of Lord Ogilvie " [i.e., David, s. and h. ap. of John, who, but for the attainder of his brother, by act, i Geo. I., would have been from 1731 to 1761, Earl of Airlie. He himself, but for such attainder, would have been, in 1761, Earl of Airlie]. The list also contains the following persons connected with the Scottish nobility, viz.. Lord George Murray (br. to the Duke of Atholl), Lord Lewis Gordon (br. to the Duke of Gordon), "John Drummond taking upon himself the style or title of Lord John Drummond, br. to James, taking on himself the title of Duke of Perth," five of the clan of Mac- donald, four of that of Cameron, i£c. The holders of four of these seven Peerages were condemned to death, of whom Balmerinoch and Kilmarnock were (accordingly) beheaded on 18 August 1746, Lovat on 9 April 1747, while Cromarty was subsequently pardoned.
