THE FIRST PARLIAMENT 4y-r . 1 ITEM, His Majeftie and Eftates forefaid, revokes, caffes, annuls, retreats, and refeinds all and fundrie Infe'ftmenrs, charters, gifts, donations, confirmations , alienations, penfions and other difpo- fitions whatfoever made , convoyed, figned, or confented unto by his Majeftie , or by his Majefties um- while deareft Father, or by any other his Majefties Predeceffbrs in their feveral times , to whatfoever perfon orperfons, in any manner of way, in fee , few-ferme , frank-tennement or otherwife whatfoever, of any lands, rents, Lordfliips, Barronies, Patronages of Kirks , cuftomes , annuals, fiftiings, liberties of fiih- ings , burrow-mails , other rents , Caftle-wards , or other whatfoever annext to the Crowne , offices of Jufti'ciary, Stewartrie, and Bailliarie , within the fame appertaining there-unto, contarie to the Acls of an- nexation made there-upon of before. And where lawful ciiflblutior! of the faid annexation wag not made by his Majeftie , his faid umwhile deareft Father, and his faids predeceffbrs , Kings of Scotland , in their majoritie, with content of the three Eftates of Parliament , in their feveral times , for fetting of the fame in few-ferme , with augmentation of the rental : To the effect the fame may be of none availe in time camming , after the date hereof, by way of action, exception, or reply. ITEM, His Majeftie with confent forefaid, revokes, annuls, retreats, and refeinds all infeftments , donations , ' alienations , and other difpofitions whatfoever made by his Maieftie , or his faid umwhile deareft Father , either in their Minoritie to their hurt and lefion , or in their Majoritie againft the Lawes and Acts of Parliament, to whatfoever perfon , orperfons, of whatfoever lands , rents, annuals, and revenews not annext to the Crown, whereof his Majefties umwhile deareft Grand : mother Queen Mary , was in pofferTion before the Coronation of his Majefties umwhile deareft Father of happy memorie. And of all offices , fuch as Chamberlanaries , Bailliaries, office ofCuftomarie made for moeyeares, but from the Exchequer , till the compt be made in the Exchequer following, Conftableries , Bailliaries, Tackes and rentals of his Majefties proner lands and rents, above the fpace of fiveyeares, made and granted contrary and againft the Lawes and Afts of Parliament of the Kingdome, the fame being fo found andtryed. ITEM,, His Majeftie with confent of the Eftates, revokes, caffes,. annuls , retreats, and refeinds ,; all and whatfoever Infeftments , rentals, and other rights whatfoever of any part of the annext property, or ofthefew-fermes of whatfoever proper lands annext to his Majefties Crowne, made to whatfoever perfon by his Majeftie, or his umwhile deareft Father ; or any other his Majefties predeceffbrs, which are made in diminution of the rental , and hurt of the patrimonie of the Crowne , where the diminution may be proved and verified. ITEM, His Majeftie revokes , caffes, annuls, retreats, and refeinds all and whatfoever Infeftments,; alienations, and difpofitions , made by his Majeftie, or by his umwhile deareft Father , or any other his Majefties Noble Progenitors , of the few-ferme visual of any lands pertaining to the Crowne; which were lawfully fet in few of before, for payment of the few-ferme victual : and the fame few-ferme visual is fet there- after in few, or otherwife for filver payment; becaufe fuch a fet or few-ferme being fo found andtryed, is clearly underftood to be to the great abufe, hurt, and diminution of His Majefties Patromonie and rent. ITEM, His Majeftie revokes , caffes , annuls, retreats, and refeinds all Infeftments , alienations, and difpofitions , with all tackes . and affedations , and any other fort of conveyances whatfoever made by his Majeftie , or his Majefties deareft Father , or any other His Majefties PredecefTors , Kings of Scotland -j againft the Lawes of the Kingdome , to whatfoever perfons , of his IVtajefties Caftles , and Houfes , or Places, and Roomes , whereupon the faids Caftles and houfes were fituat , although now demolifhed by injury done - to his Majeftie and the faid Crown. Andficklike, all Infeftments , alienations, and difpofitions , and all other fort of conveyances whatfoever , of any of his Majefties medowes , woods , and parks , with all tackes , affedations, and other difpofitions thereof, made by his Majeftie or his Predeceffbrs forefaid , againft the Lawes of the Kingdome, The fame being fo found andtryed. ITEM, His Majeftie, revokes, retreats, and refeinds all and fundrie" Infeftments, alienations, gifts, difpofitions , or any other conveyances , whatfoever made by his Majefties faid umwhile deareft Father , or any other his Majefties Predeceffbrs , Kings of Scotland, induring their minoritie and leffe age , and not there- after confirmed in their majoritie , to whatfoever perfon or perfons in few-ferme - or life-rent , of ail lands , and annuel-rents which become in their hands, as propertie by right of the Crowne, through baftardrie, or being laft Heire by ilfcognition , or forefaulter , or otherwife with all confirmations , if any be granted in Par- liament thereupon : providing that prefentation to tennandries fallen by occafion forefaid , fhall in no wayes come under this prefent Revocation , becaufe the fame being cafualities , coulde not remaine in his Majeftie, or his faids predeceffbrs hands , in prejudice of the Superior of the faids tennandr es, but of neceffitie it behoved them to prefent heritable Tennants to the faids Superiours . ITEM, His Majeftie, with confent forefaid , revokes, caffes, annuls, all new Infeftments , confir- mations, and other conveyances whatfoever given by his Majefties faid umwhile deareft Father, or any other His Majefties predeceflbrs , Kings of Scotland; to whatfoever perfon or perfons, of any Lands. Baronies, Lordfliips, or other Heritages whatfoever: To beholden in blenfh ferme, which were hold- en of his Majeftie or his Predeceffbrs of before , by fervice of ward and reliefe.
