Re: Prohibition of interception of telephone or any other communication devices
Whereas there has been unlawful interception, exploitation, or disclosure of information communicated through telephone or any other communication devices over the past period of time, which gives rise to violations of the freedom of communication of other persons and results in general fear amongst the people who use communication devices;
Therefore, the Council for Democratic Reform hereby gives the following announcement in order to protect the freedom of lawful communication, bring about orderliness, and maintain national order:
Article1.Whoever, without lawful power, intercepts, exploits, or discloses information communicated by telephone or any other communication device shall be punished with imprisonment of not over five years, or a fine of not over one hundred thousand baht, or both the imprisonment and the fine.
Article2.Whoever, having learnt of the information obtained from the commission of the offence under article 1, exploits or discloses such information to another person without lawful power, shall be punished with imprisonment of not over five years, or a fine of not over one hundred thousand baht, or both the imprisonment and the fine.
Article3.Whoever induces another person to commit the offence under article 1 or 2 shall be punished with twice the punishment provided for the offence under article 1 or 2, as the case may be.
Article4.If the offender is a person who has been licensed to provide a telephone or communication service or has obtained concession to provide such service, he shall, in addition to being punished in accordance with article 1, 2, or 3, as the case may be, lose the licence or concession also.
This Announcement shall take effect from the day following the day of its publication in the Royal Gazette onwards.
