49/236. Mission for the Verification of Human Rights and of
Compliance with the Commitments of the Comprehensive
Agreement on Human Rights in Guatemala

The General Assembly,
Recalling its resolutions 45/15 of 20 November 1990, 46/109 A of 17 December 1991, 47/118 of 18 December 1992, 48/161 of 20 December 1993 and 48/267 of 19 September 1994, in which it decided to establish the Mission for the Verification of Human Rights and of Compliance with the Commitments of the Comprehensive Agreement on Human Rights in Guatemala, and its resolutions 49/137 of 19 December 1994 and, in particular, 49/236 A of 31 March 1995, in which it decided to authorize the renewal of the mandate of the Mission for a further period of six months,
Welcoming the signing by the parties on 31 March 1995 of the Agreement on Identity and Rights of Indigenous Peoples,[1]
Taking into account the note by the Secretary-General containing the second report of the Director of the Mission,[2]
Taking note of the recommendations addressed to the Government of Guatemala and the Unidad Revolucionaria Nacional Guatemalteca contained in the second report of the Director of the Mission, regarding the implementation of their commitments under the Comprehensive Agreement on Human Rights,[3]
Also taking note of the request of the parties regarding the immediate verification by the Mission of human rights aspects of the Agreement on Identity and Rights of Indigenous Peoples and the recommendation of the Secretary-General contained in his report on the Mission[4] on resources required to allow the Mission to continue to fulfil its mandate, including verification activities relating to human rights aspects of the Agreement,
Stressing once again the importance of mobilizing national and international resources to strengthen the Guatemalan system for the protection of human rights,
Welcoming, in that respect, the support of the donor community for the implementation of the agreements reached in the Guatemala peace process, including the Comprehensive Agreement on Human Rights, expressed in Guatemala and reiterated at the informal donors meeting on Guatemala held in Paris on 21 June 1995 under the auspices of the World Bank,
Acknowledging the efforts of the Secretary-General, the Group of Friends of the Guatemala peace process [5] and the United Nations agencies and programmes concerned for their support to the Guatemala peace process,
Emphasizing the importance it attaches to the full observance by the parties of human rights and the other commitments they have undertaken,
Stressing the need to continue the existing momentum towards the early conclusion of an agreement on a firm and lasting peace,
Having considered the recommendation of the Secretary-General regarding the extension of the mandate of the Mission, contained in his report on the Mission,
1. Stresses the significance of the Agreement on Identity and Rights of Indigenous Peoples as an important step in the Guatemala peace process and a landmark in the International Decade of the World’s Indigenous People; [6]
2. Welcomes the report of the Secretary-General on the United Nations Mission for the Verification of Human Rights and of Compliance with the Commitments of the Comprehensive Agreement on Human Rights in Guatemala; 4/
3. Takes note with satisfaction of the second report of the Director of the Mission;
4. Decides to authorize the renewal of the mandate of the Mission for a further period of six months, that is, until 18 March 1996, in accordance with the recommendation of the Secretary-General;
5. Welcomes the efforts of international and regional financial institutions aiming at mobilizing resources for the implementation of the Guatemala peace agreements, including the Comprehensive Agreement on Human Rights;
6. Also welcomes voluntary contributions already made to the Trust Fund for the Guatemala peace process established by the Secretary-General, and invites the international community to make further contributions to the Fund;
7. Calls upon the Government of Guatemala and the Unidad Revolucionaria Nacional Guatemalteca to implement the recommendations contained in the first [7] and second reports of the Director of the Mission and to comply fully with their commitments under the Comprehensive Agreement on Human Rights and with the human rights aspects of the Agreement on Identity and Rights of Indigenous Peoples;
8. Reiterates the importance of the undertaking by the parties, contained in the Comprehensive Agreement on Human Rights, to provide their broadest support to the Mission and whatever cooperation it may need to carry out its functions, particularly with respect to the security of the members of the Mission;
9. Calls upon the parties to reach agreement on the item entitled "Socio-economic aspects and agrarian situation", currently under discussion in the negotiating process, and to strive for the earliest conclusion of an agreement on a firm and lasting peace;
10. Requests the Secretary-General to keep the General Assembly fully informed of the implementation of the present resolution.
