D. 1662. lawfully and duly tendred ; (3 ) or fhall endeavour to perfwade any other Perfon to whom any fuch Oath (liall in like Manner be duly and lawfully tendred, to refufe and forbear the Taking of the fame ; (4) or Ihall by Printing, Writing or otherwife, go about to maintain and defend that the Taking of an Oath in any cafe whatfoever, is altogether unlawful: (5) And if the faid Perfons commonly called fakers, ftiall at any Time after the faid four and twentieth Day of March depart from the Places of their feveral Ha- bitations, and affemble themfelves to the Number of five or more, of the Age of iixteen Years or up- wards, at any one Time, in any Place, under Pretence of joining in a Religious Worlhip, not autho- rized by the Laws of this Realm ; (6) that then in all and every luch Cafes, the Party fo offending be- ing thereof lawfully convift by Verdid of twelve Men, or by his own Confeflion, or by the notorious Evidence of the Fa<5t, Ihall lofe and forfeit to the King's Majefty, his Heirs and Succeffors, for the firft Offence, fuch Sum as fhall be impofed upon him or her, not exceeding five Pounds ; (7) andifanyPer- fon or Perfons, being once convidted of any fuch Offence, fliall again offend therein, and fliall in Form aforefaid be thereof lawfully convifted, fliall for the fecond Offence forfeit to the King our fovereign Lord, his Heirs and Succeffors, fuch Sum as fliall be impofed upon him or her, not exceeding ten Pounds : (8) The faid refpedive Penalties to be levied by Diflrefs and Sale of the Parties Goods fo con- vidfed, by Warrant of the Parties before whom they fhall be fo convidted, rendring the Overplus to the Owners, if any be ; (g) and for Want of fuch Diflrefs or Nonpayment of the faid Penalty within one Week after fuch Convidlion, that then the faid Parties fo convided fhall for the firft Offence be com- mitted to the Common Gaol or Houfe of Correftion for the Space of three Months ; and for the fecond Offence, during fix Months, without Bail or Mainprife, there to be kept at hard Labour ; (10) which faid Monies fo to be levied, Ihall be paid to fuch Perfon or Perfons as fhall be appointed by thofe before whom they fliall be convi6led, to be imployed for the Increafe of the Stock of the Houfe of Correciion to which they fhall be coinmitted, and providing Materials to fet them on Work : (11) And if any Per- fon after he, in Form aforefaid, hath been twice convidt of any of the faid Offences, fhall offend the third Time, and be thereof, in Form aforefaid, lawfully convidt, that then every Perfon fo offending and convid fhall for his or h«r third Offence abjure the Realm ; or otherwife it fhall and may be lawful to and for his Majefly, his Heirs and Succeffors, to give Order, and to caufe him, her or them to be tranfported in any Ship or Ships, to any of his Majefty's Plantations beyond the Seas, IIL And it is ordained and enadled by the Authority aforefaid. That all and every Juflice of Oye7' and Terminer, Juflices of AfUze and Gaol-delivery, and the Juif ices of the Peace, fhall have full Power and Authority in every of their open and General Seflions, to enquire, hear and determine all and every the faid Offences within the Limits of their Commiffion to them diredted, and to make Procefs for the Exe- cution of the fame, as they may do againft; any Perfon being indidted before them of Trefpafs,, or law- fully convidled thereof. IV. And be it alfo enadted. That it fhall and may be lawful to and for any Juftice of Peace, Mayor, or other Chief Officer of any Corporation, within their feveral Jurisdidtions, to commit to the common Gaol, or bind over with fufficient Sureties to the Quarter-Seffions, any Perfon or Perfons offending in the Premiffes, in order to his or their Convidtion aforefaid, V. Provided always, and be it hereby further enadted. That if any of the faid Perfons fhall after fuch Convidtion as aforefaid, take fuch Oath or Oaths, for which he or fhe flands committed, and alfo give Security, that he or fhe fhall for the Time to come forbear to meet in any fuch unlawful Ailembly as afo^ «j| faid, that then and from thenceforth, fuch Perfon and Perfons fhall be difcharged from all the Penalties-i aforefaid ; any Thing in this Adl to the contrary notwithflanding. Commiflioners to be named by his Majeify under the Great Seal for Surveying and Cleanfing the Street's and High- ways. Encroachments that have continued thirty Years, not to be removed but upon Satisfadlion to the Parties. The Barons of the Exchequer to judge of the Satisfadlion, if refufed upon Tender. Con- vidlion for Encroachments upon View, and the Penalty. No Hackney-Coaches to be without Licence, Mutt. 99. Who may be licenced to keep Hackney-Coaches. Hackney Coaches not to exceed 400 in Number. The feveral Rates allowed for Hackney-Coaches. The Penalty^for exadling more. All Streets and Lanes to be cleanfed every Week. None to cafl any Afhes, or Duft before their Houfes. No Barrels, Timber, Coaches or other Things to be fet or amended in the Streets. The Duty of the Scavengers and Rakers weekly. All open Streets to be paved and fo kept by the feveral Houfeholders. Provifo for the Borough of Southzvark. Candles or Lights to be hung out every Night from Muhaelnui} to Lady-day. Rates and Taxes to be made for defraying the Charges and Wages of Scavengers and i| others.
