' ceived and been iiititled to receive certain Duties called Petty Cuftoms or Wharfage, upon the Imoortia- ' tion and Exportation of all Goods and Merchandizes into and out of the Harbour of IVaym-uth ansi Md- ' comhe Regis aforefaid, from the Owner, Importer or Exporter of fuch Goods and Merchandizes, and alfo
- certain other Duties there called Harbour-dues and Ballaft-duty, from the Maflers or Commanders of
- Ships and Veffels ; and which faid feveral Dues and Duties have been conflantly under the Management
' of the Rdayor, Aldermen, Bailiffs and Capital or Principal Burgeffes of the faid Borough and Tov/n, as ' Truftees and Managers ; and have been applied for the repairing the faid Harbour, Quays and Wharfs, ' and other publick Buildings and Works within the faid Borough and Town : And whereas of late Years ' feveral Perfons have refufed to pay the faid Duties, and have been induced thereto by means of the great
- Difficulties in fupporting, by ffrift legal Evidence, prefcriptive Claims and Rights to Duties on each par-
' ticular Species of Goods, and the Exa£t and precife Sums payable for the fame; and although the faid ' Mayor, Aldermen, Bailiffs, Burgeffes and Commonalty, in order to fupport their Right to the fame, ' have brought feveral Aflions and obtained Verdifts of Damages, by' which fuch their Right in General ' hath been eftablifhed; yet by means of the Expences in carrying on fuch Suits, and the many continued
- Evafions and Refufals of Payment, the Fund for the repairing the faid Harbour, Quays and Wharfs, and
' other publick Buildings and Works, hath been confiderably leffened, and the faid Wharfs, Quays and
- other Buildings and Works are now in a ruinous Condition, and will be intirely dcftroyed if not timely
- prevented;' for Remedy whereof. Be it enacted, &c.
" There fhall be paid to the Mayor, ^c. of IFaytnouth zni Mekombe Regis, for all Goods imported and ex- " ported, and for all Ships coming into the Harbour, the Duties fpecified in the Schedules annexed. Col- " ie£tor, Qiiay-mafter and Treafuier to be appointed; with Salaries not exceeding zs. in the Pound of the " Money received. The Accounts to be audited every Year, Accounts may be infpefted by the Inhabi- " tants, and Copies taken. Mafter of Ship to deliver to the Collector his Wharfage Bill, on Penalty of
