[P“bH"· N°‘ S1'] Be it emwted by the Senate and House of Representatives of the United States of America in Congress assembled, That the consent ¥ZR°'3p@’N,Y, of Congress is hereby granted to the village of Port Chester, New ,j,Fg‘y°f,$;•g1¤”i°h·C°¤¤~ York, and the town of Greenwich, Connecticut, or either of them, ` to construct, maintain, and operate, at a point suitable to the interests of navigation, a dam across the Byram River at or near such village hm and town: Provided, That the work shall not be bommenced until App;-p?A1p1p1ppS, the plans therefor have been submitted to and approved by the Chief of Engineers, United States Army, and b the Secretary of War: U m M Provided further, That this Act shall not ble construed to authorize S° r°° ° ' the use of such dam to develop water power or generate hydroelectric energy. _ Sec. 2. That the authority granted by this Act shall cease and be T*m°°'°°“‘”“°“°"‘ null and void unless the actual construction of the dam hereby authorized is commenced within one year and completed within three years from the date of approval of this Act :_ Provided, That from 4%,,,,;,,,,,,,,. and after thirty days’ notice from the Federal Power Commission, P,$'°°rg&1•g§g;>¤¤¤* i¤· or other authorized agency of the United States, to said village and ` town, or either of them, that desirable water-power development will be interfered with by the existence of said dam, the authority hereby granted to construct, maintain, and operate said dam shall terminate A th and be at an end; and any grantee or licensee of the United States orvgweiriirydgitirmtw prolposing to develop a power project at or near said dam shall have Cmdmm authority to remove, su merge, or utilize said dam xmder such con- ' ditions as said commission or other agency may determine, but such conditions shall not include compensation for the removal, submergence, or utilization of said dam. _ Sec. 3.
